Commentary: First on Trump to-do list is pardon for Clinton
Philly.com ^ | 11/16/2016 | Jeremy Rabkin and John Yoo

Donald Trump's election has raised deep concerns, even among his supporters, that he may misuse the vast powers of the presidency. We believe that he can take early steps now, even before he takes office, to signal that he will use executive power to unify the country, despite a campaign that emphasized differences within the Republican Party and among American voters generally.

Trump should look for policy initiatives where he can appeal to both Republicans and Democrats. He will need Congress' support for tax cuts, regulatory reform, and a rejuvenated military. We believe he can make three commitments, well within the president's constitutional authorities, to show that he will use the office in the public interest and to respect democracy, rather than lean toward authoritarianism.

First: The president-elect should promise a pardon, on day one, for Hillary Clinton. Article II of the Constitution places no limit on the president's power to "grant reprieves and Pardons for Offences against the United States," except for impeachment. Many Americans believe Clinton was guilty of conduct that would trigger prosecution of a lesser figure. But an actual prosecution would create the terrible appearance of pursuing his political opponents with criminal law. A prosecution would divert attention from all other Trump initiatives and discourage any compromise and cooperation from Democrats.

Saving the country from bitter turmoil is one of the reasons why the president has a pardon power. [snip] It would signal that Clinton violated the law with her private email server and mishandling of classified information. Nor would a pardon bar the Justice Department from fully investigating any corruption involving the Clinton Foundation. A pardon would show that a President-elect Trump can win with grace, put the nastiness of the campaign behind us all, and focus our energies on the future.

So Philly.com knowingly supported a candidate for President who would need a pardon to stay out of prison?

If GWB had done his job, we wouldn’t have been saddled with Clinton corruption. If Trump doesn’t do his duty, it just shows we really are a banana republic. The dems cover for her and the pubbies let her slide.

she’s supremely amoral and wikileaks illustrated that she did not mind repeatedly rubbing elbows with ongoing child molesters.

whether she molested any child herself, is up for any investigation to locate. not even wikileaks produced that kind of smoking gun. going off half cocked about this kind of thing always comes back to bite later.

“...However, a pardon would permanently scar her legacy...”

And a lengthy prison sentence wouldn’t????

In a different time she would have been locked up and faced trial for treason.

We do not live in those times. As I have posted before, I share your bloodlust, but half the people don't. They believe:

1) She is being unjustly pursued by a vast right wing conspiracy.

2) She is innocent.

3) If she did do anything the ends justify the means.

4) The laws don't apply to liberals like Hillary.

5) Any combination of the above.

This is the mindset of almost half of your fellow citizens. It is their reality, not ours. They have truly lost their minds. Imagine their reaction to her prosecution, no matter how much proof you have of her crimes.

How does he pardon hillary without letting the Clinton Foundation off the hook for stuff like ripping off Haiti disaster relief funds? How does he get cut through the mess of Mideast financial gifts influencing our political process?

Without the threat of jailtime for her and her henchpeople, lots of bad stuff will stay just like it is.

to help restore law and order HILLARY must be prosecuted
it was a campaign promise and people voted for trump as a way of voting to convict hillary
anything less will allow current future corruption to flourish.

corruption is a cancer on the government and must be cut out completely

healing can take place after the punishment.
to let her off the hook again would be a travesty of justice.

file enough serious charges against her to give her a chance to plea guilty to lesser charge
as for the foundation it needs to be destroyed and penniless

chelsea needs to be charged also if indicated to prevent her from running for future office/position in the us
when you clean house make it a clean sweep

Read my post. He can give her a conditional pardon for any crimes committed while she was SOS. That does not let her off the hook for crimes committed previous or subsequent to that. It also does not let Bill or Chelsea off the hook.

Trump looks magnanimous in victory and the Clintons are still in a heap of trouble. What are people going to riot for then? An unconditional pardon???

I suspect she does have material on O. But it’s likely of a nature that if she disclosed it, it would expose her own criminality. Like one bank robber threatening to go to the cops if the other doesn’t cough up more money. So in the end the effect will be as if she had nothing on him.

On the other hand, if O pardons H and the investigation uncovers criminal behavior on his part, he has no bargaining chip. He can’t say “I’ll rollover on Hillary for immunity!”. So I would think he has a vested interest in not pardoning her.

I could imagine Trump publishing a list of the most solid and serious accusations against Hillary and then asking people in polls, what do they think ought to be done.

She is a willfully destructive pest.

“that he may misuse the vast powers of the presidency.”

I think you meant to say obama ‘did’ misuse the vast powers of the presidency.

Pardons are for penalties imposed by a legal authority upon conviction for a crime. So do they want to admit that hillary committed a crime?

She MUST be held accountable for her actions, otherwise why have any laws at all including against acts of TREASON. WHEN will people understand there MUST be ACCOUNTABILITY and BREAKING the LAW has consequences? Make an example of her or forget about restoring LAW and ORDER in the USA.

Trump should say that his AG will confer with the FBI and it’s up to the professionals in law enforement whether to proceed. Too many people have been prosecuted for less than what we know about Mrs. Clinton, we can’t just look the other way because of “who she is.” That is not the American way of everyone being “equal under the law.”

I did read your post. I wouldn't pardon her for anything, especially as Secretary of State! If she was aiding in illegally getting weapons to terrorists, that's treason. Then there's all the bad things that happened with the toppling of legitimate governments. etc ad nauseum

It might get weird if some Republican Senators and other hight-ups are involved. That would just be icing on the cake!
