Senate hearing scheduled for life-support bill created after Norwalk woman's slaying

House Bill 451 will have its first hearing in the Ohio Senate on Tuesday. The bill, which would affect who decides a person on life support’s fate, was drafted in response to the 2011 stabbing death of local woman, Maria Vera.

In particular, the bill would offer protections in the case that spouses were in the middle of a divorce, legal separation or dissolution. It would also take into consideration situations where the victim has a temporary or civil protection order against their family member. In that case, that family member would not be allowed to determine what happens to the victim on life support.

Vera, 22, of Norwalk, was attacked by her estranged husband, Jeremy Gallant, after they got into an argument while she was collecting belongings from his Berlin Township home in June 2011. Gallant repeatedly stabbed Vera in the face, neck and head.

She was on life support for two weeks before she died.

House Bill 451 was created in response to Vera’s death.

Hat tip to Bykr Bayb. Bringing the topic of right to life to our attention again - hopefully the legistlators of Ohio will vote to protect the helpless from death mongers. This situation is not analogous to Terri's, but is in one respect: The estranged "husband" murdered her, and therefore should not have had any say in her medical care one way or another. Another side point is that the punishment for murder has gone down so much - this fiend will be eligible for parole in 18 years! Murder should mandate the death penalty, and swiftly.

Thanks for posting this.

It’s just common sense that anyone who tries to murder their spouse should not be allowed to make life and death medical decisions for their victim. Look what happened to Terri Schiavo.

Man, her story STILL hurts my heart. And now, we have another one? But, at least Ohio is doing something about it.

And let’s never forget to tie Gov. Jeb Bush to Terri whenever we can!

I’m not comfortable with the idea of anyone being allowed to order the killing of another, or for medical personnel to participate in the killing. This legislation seems to be an attempt to at least block people from making life and death choices for people when they’ve demonstrated a lack of concern for the patient.

The woman whose tragic death inspired this legislation was kept on life support by her estranged husband, in an attempt to avoid a murder charge. Unlike Terri Schiavo and so many others, I believe she was already dead. She had intended to donate her organs, but in a couple weeks after the attack, her organs had deteriorated beyond being suitable for transplant. I think this was because she was dead.

Unfortunately, our healthcare system has deteriorated to the point that we can’t trust doctors to tell the truth about whether or not a patient is even alive. They will declare patients brain dead while the brain is still functioning. (Anyone heard anything lately on Jahi McMath?)

Jeb Bush will forever be Pontius Pilate in my eyes.

Here's a letter written by Beverly Vera, to the Ohio legislature. I think she's the step-mother of Maria Vera, whose death was the inspiration for this bill.

If you've ever been in an abusive relationship, or had a loved one who was, this is a hard letter to read.

I think Jeb is fading into the annals of also-ran history.

I do not know or care what his election platform was. I would never support him because of how he refused to do anything to save Terri from a brutal, painful death. I wonder how many others like me contributed to his expensive and absolute flop of a campaign?

The Jahi McMath situation is not a right to life case. Jahi is dead, and has been so since December 2013.

Her family occasionally makes noise about her still being alive, and publicizes efforts to have her declared not dead just because they have been able to preserve the body in a life-like state.

The fact is, that no reputable doctor has been able to examine Jahi; there is, in fact, no verification of her current status. If there were any evidence whatsoever—a voluntary movement, independent breathing, etc.—that she is actually alive, her family would have trumpeted it. Not only has there been nothing of the sort, but it has become extremely difficult to find any new updates on the case at all. For all anyone outside the family knows, they buried her secretly and keep trotting out old pictures to use to ask for donations.

One of the things I really dislike about the Jahi case is that it is lumped in with actual right to life cases. Treating every single case where the family wants to pull or prolong life support as if those cases are all the same without knowing or understanding any of the medical issues involved does not advance the pro-life cause. On the contrary, it makes pro-lifers look like kooks.

Jahi McMath: no brain activity, ergo, dead.

Terri Schindler: impaired, with a brain functioning to keep life processes going without external interference. Probably had decreased awareness as compared to a non-brain damaged person and definitely helpless, but alive until a deliberate act killed her.

The medical status of the woman in this story was not described anywhere. Her family wanted to pull her from life support, while the man who attacked her wanted her to remain on life support. It could be that she really was on her way out, and the attacker wanted to keep her on life support hoping for a miracle that would keep him from being charged with murder.

The bottom line is that each case must be judged on its own merits.

Very important points, Bykr Bayb. “Ethics” boards on hospitals are often the exact opposite. Maybe some organization has a list of doctors who are not on the death bandwagon, or organizations that can help. Keeping someone who has actually died “alive” for evil motives is also terrible. Basically any person who is estranged from another, not a well wisher, has ulterior motives, expressed ill intentions, etc - should never have power of attorney over that person. Ever. This also brings up the point that people should be pro-active, make their medical wishes clear, written down in a legally binding way, and appoint a trusted well wisher to have power of attorney should the need arise.

Terri’s story still hurts me also. Jeb Bush was horrible. Yet Terri was not brought up during the primaries. I wonder how Kasich feels about this bill.

Hi, BB. Well, we know Trump is going to do something drastic to Obamacare. With Sara Palin bugging Trump now and then, maybe the Death Panels will be axed. It’s Zeke Emmanuel and Michael Schiavo’s attorney who wrote the exit protocols and the death panel parts of Obamacare. Seventy five year olds are in the cross hairs if we do not fix Justice Roberts’ horrible mistake (I think he was probably threatened or blackmailed) to go w/ACA.

I noticed that Jeb isn’t the next president. He mishandled Terri’s life and his attorney caved, the attorney who was going to brilliantly win for her. I never forgot. He needs to stay in private life because if he can’t protect one, he cannot protect no one.

Terri doesn’t even need to be brought up. Everyone knows that she got a raw deal. She was hidden which is called caging so nobody could see how together she actually was. She was murdered. Everyone who spent days, months and years to help her were sickened by what GWB did. He faked everyone out. I quit the RNC after that. I will not be in a party that didn’t save an American. Terri was Benghazi before there was a Benghazi.

I still have Terri threads on my in forum page. My friend lost the list but we had about a 36 page list of all the threads about Terri. That accounted for thousands upon thousands of posts and threads. Wish my friend had not lost the list. I don’t have all of them on my page; just some.
