Appeals court refuses to halt trial in USS Cole attack

A federal appeals court on Tuesday refused to halt the military commission trial of a Saudi national charged with orchestrating the 2000 attack on the USS Cole that killed 17 U.S. sailors.

The 2-1 ruling said that Abd al Rahim al-Nashiri can’t challenge the commission’s authority to hear his case until after the proceeding has run its course.

Al-Nashiri argued that military commissions only have authority over offenses that take place during an armed conflict. He said his actions were not war crimes because the U.S. was not officially at war with al-Qaida at the time of the attack.

But the U.S. Court of Appeals for the District of Columbia Circuit said the military court was capable of deciding whether al-Nashiri’s conduct occurred “outside the context of hostilities.” …

AFTER the explosion on the USS Cole in fact the captain forbade distribution of live ammo.

incredibly the reason he had was he wanted to **prevent a tragedy.**

after the explosion, mind you.

there was a risk of a follow-up, finishing attack and nobody had any live ammo.

Anyone ever ask themselves how a bunch of terrorist are able to use enough explosives in a tiny boat to blow a gigantic hole in a thick armor plated war ship? What I read was that russia actually supplied a special explosive to do the job, thinking we had something to do with the sinking of their submarine the Kursk. Anyone else hear this? I also heard this was the second attempt as the first boat sunk because it was over loaded.

They are glass-jawed as a result.

Well...precisely. The US may not have declared war against ISIS - perhaps they never have - but ISIS certainly has declared war against the US, making him an enemy combatant.

A Bradley probably has better armor than the Cole. Certainly so for an M1, let alone an M1A2.
