The European Union on Tuesday said US tech giant Apple must repay a record 13 billion euros ($14.3 billion or roughly Rs. 95,910 crores) in back taxes after ruling that a series of Irish sweetheart tax deals were illegal.
"The European Commission has concluded that Ireland granted undue tax benefits of up to 13 billion euros to Apple. This is illegal under EU state aid rules because it allowed Apple to pay substantially less tax than other businesses. Ireland must now recover the illegal aid," a Commission statement said.
EU Competition Commissioner Margrethe Vestager said Apple's "selective treatment" in Ireland meant it paid an effective tax rate of just one percent on its European profits in 2003, which then fell to a bare 0.005 percent by 2014.
"The tax treatment in Ireland enabled Apple to avoid taxation on almost all profits generated by sales of Apple products in the entire EU single market."
Brussels launched an inquiry into Apple's tax arrangements in Ireland in 2014, one of a series of anti-trust cases targeting major US corporations that have angered Washington.

Apple's pays the bulk of its taxes in the United States, where it is headquarters are located, where it reports its profits. Last year its effective US effective Corporate INCOME TAX RATE was a bit over 27%. Alphabet/Google's was something like 16.81%, Microsoft's was 34%, because the posted a huge write off in the last quarter, reducing the bottom line. However in 2014, their effective tax rate was 20%. Amazon's is about the same as Apple's.
So much for your 0.005% tax rate for Apple.

I am certain that the article was part of a vast right wing conspiracy from the same people trying to pick on poor Hillary. And it actually was based largely on information from a congressional inquiry which found, “Apple wasn't even reporting its U.S. taxes accurately, either, the Senate subcommittee found. Its (Apple's) annual report disclosed it paid much higher U.S. taxes than it actually paid to the IRS.”
Apple's statements about the taxes that it does or does not pay seem to directly parallel the claims Hillary Clinton made about her experiences as Secretary of State when she spoke to Congress. In other words, Apple and Hillary lie... a lot. And every once in a while it catches up with them... sometimes with humorous results.
Apple doesn't "pretend" it's based in Ireland. Apple's headquarters are in Cupertino, California. They pay taxes in the United States and California using that address, not from Ireland. Ireland is Apple's European headquarters, manufacturing, and distribution center. All Apple products in Europe come from Ireland. Sales generated in Europe are taxed based on its laws. If it were based in Germany, it would be taxed on German laws. All of the EU recognizes that system. . . Except for this Commission who want to unilaterally regulate all EU countries' tax laws to be the same with out having the authority to do so. The treaty that established the EU among its member nations allowed all member nations to retain autonomy in their tax laws and regulations, and recognized reciprocity of those laws among the several nations.
The same principle is recognized among ALL of the nations of the world. It is what allows businesses to maintain some sense of sanity in a world of multiple taxing authorities. . . A company is taxed by its home nation for the majority of its income taxes. Other taxes are local.
Business Insider is quoting a Democratic Senator's committee research, which HAD claimed Apple paid ZERO US income taxes, a facturd that was thoroughly shot down in hearing during which Apple submitted its AUDITED US Corporate Income Tax Returns for the previous years show that not only had Apple PAID US Income Taxes, but that it was the LARGEST payer of US corporate income Taxes in two of the last five years!
In 2012, Apple had paid $1 out of every $40 the IRS had collected from ALL businesses in the United States that year. Not one cent of money earned Apple has in the US has found its way to Ireland.
Apple's effective US Tax Rate has varied from a high of 29% to a low of 25.28% depending on expenses. You can look these figures up on Google. If Apple and its officers are reporting LIES on its AUDITED Financial statements, then under the Sarbanes Oxley Act of 2002, Apple's officers would be personally liable for fines and prison sentences of up to $20 million and 20 years in Federal prison, per lie. These are SERIOUS charges. In addition, Apple itself would be liable for Stockhold suits since every stockholder uses both tax returns and financial statements to make their investment decisions, and the amount of their compensation is determined by much of those amounts. If the management is playing around with those figures, an easy thing to find, they'd sue Apple, the officers, the board, and the accountancy firm who certified all of those figures as true and accurate for EVERYTHING THEY OWN!
Since you claim they have mis-reported the amounts they have paid on TAX RETURNS to the Federal Government, on Financial Statements, these would be easily checkable LIES. These figures MUST balance. They'd stick out like a smashed thumb. . . Yes it was most likely a crime, but that is why Apple spends a gazillion dollars on lawyers... so they can skirt the law. It is sweet justice that in this European Union tax ruling they finally were called on their illegal activities.

So the difference between the financial statement they released to investors was off by a mere $4 Billion according to the Senate investigation. But it is easy to see how a million here and a million there and the addition gets a little screwed up.

Had that subcommittee report been correct, Tim Cook and his auditors would be languishing in JAIL and subject to major fines. I've seen both. That report is NOT a report to "investors," it is a FINANCIAL REPORT to the Federal Exchange Commission, a part of the Federal Government which investors are free to see, and is also filed WITH Apple's Tax Return. They have to agree. Don't you know anything? Apparently not. And they DID agree.
If you'd bother to read the foot note on Page 39 where the article got its piece of misinformation from the subcommittee's report, which even the researchers obviously did not understand what they included, Apple's 10K FINANCIAL STATEMENT filed with the SEC footnoted the following:
"According to Apples 2011 10-K, the company had net excess tax benefits from stock based compensation which is the main reason for the difference between Apples current tax liability on its financial statement and the liability reported on Apples tax return. See Apple Inc. Form 10-K for the fiscal year ended September 29, 2011, at 63; Subcommittee interview of Phillip Bullock (5/15/2013)."
In other words, the 4.4 billion difference was being paid in a different, but completely legal FORM that particular year. . . but, oh, doesn't it make for a juicy story fodder for people who don't understand tax law? Someone, like you or the author of the article, who doesn't bother to read footnotes, or doesn't understand what they read. IRS got the total amount due, just not in that manner.

Maybe it is because Apple has more experience than any other organization in the world setting up dummy entities to hide the movement of funds to avoid paying taxes or for other nefarious purposes? No, fireman, ONCE AGAIN, you are distorting what I said. Here is my exact quotation:

Having no listing in Clinton Foundation donor listing they've released, nor having Clinton come speak at Apple or at an Apple event, IS NOT the same as having "no association with the Clinton Foundation" as you characterized my statement. (However, we do know that the Clinton Foundation is not above purging names from its donor list that are, shall we say, embarrassing to find there. We know they have done it in the past.)
It is, in fact, possible that Tim Cook did indeed make a donation to the Clinton Foundation, but it was not large enough to make the list of major or significant donors, or he made his donation as part of a group of donors which would be subsumed under the name of the group on the list. Frankly, I do not know.
Do NOT infer something in what I said that I did not say. You anti-Apple people are always putting words into what I write that I did not write. If you are going to disagree with what I write, use the words I actually wrote, not some other words you wish I had written to construct a Strawman for you to shoot down.
For all you or I know, Tim Cook may have met Bill Clinton at a Foundation event which Cook attended representing another group he is associated with, at a speaking engagement where Bill WAS the speaker, or some other relationship having to do with the Clinton Foundation in which both Bill Clinton and Tim Cook were both present. Although many of us were very suspicious of the purpose of the Foundation, just because of who they were, until the evidence started being revealed, the Clinton Foundation was mostly thought to be a beneficial non-profit, not a criminal enterprise. It was only when some enterprising and tenacious REAL journalists started turning over rocks and connecting some well hidden dots were we and the rest of the world to start learning the facts about what was really going on under Hillary's pantsuits and behind Bill's zipper.
However, the important statement here is that Tim Cook knew Bill Clinton OUTSIDE OF POLITICS, and then only peripherally, which supports what I was trying to tell you that Apple, for many years was essentially an apolitical entity even given the liberal Leanings of its leadership. In many ways, it still is.
I did not address your donation patterns you put up graphs about in an earlier post because it was late (or actually too early in the morning). . . But those had to do with Apple's efforts to enact STRONG ENCRYPTION LAWS for mobile devices, not generally about supporting just Democrats as you were implying. Notice that Republican Congressman Darryl Issa, who is NOT a supporter of Gay marriage, got a donation from Apple. Why? Because he is supporting Apple's initiative to back user privacy and strong encryption for mobile phones, tablets, and computers. Individual privacy rights. It is unfortunate, or perhaps fortunate, that there are fellow travelers in the Democrats who are also supporters of that too, but that was the test for those donations, not party line.
