The Treaty provides for a broad range of cooperation in criminal matters. Mutual assistance available under the Treaty includes obtaining the testimony or statements of persons; providing documents, records and other items; serving documents; locating or identifying persons and items; executing requests for searches and seizures; transferring persons in custody for testimony or other purposes; locating and immobilizing assets for purposes of forfeiture, restitution, or collection of fines; and any other form of legal assistance not prohibited by the laws of the Requested Party. I recommend that the Senate give early and favorable consideration to the Treaty and give its advice and consent to ratification.

While I don’t have the time (I do have the inclination and the ability, but as a lazy FReeper decline to exercise same), I would imagine such a treaty calls for a formal request made through the United States State Department to the Russian Foreign Ministry for specific information. I doubt we made that formal request. And why would Obama do that?

Actually, don’t discount this as being a stupid play. Clintons are known for character assassination and do it well. Having Russia identify to the US government those persons involved in this gives Clintons fodder for coming up with some other lame excuse as a defense. There is a number of ways the Clintons can go with this if they were to get their hands on this information. Clintons play chess and they do very well at it even though we dislike them vehemently.
With all of this said, I don’t think Putin will allow Russia to divulge this information as I believe the hacking was condoned and supported by the Russian government. This is a shot in the dark on Clinton’s part but it is a well placed one at that.

There was no active criminal investigation against the Tsarnaev brothers when the information was conveyed. The treaty regarding criminal investigations was not applicable to the Tsarnaevs. That was just basic exchange of intelligence, which was in the mutual interest of both countries.
Apples and oranges.
