Federal Court Sides With Grassroots Activists: RNC Delegates Are Bound to Follow Election Results
Delegates Remain Committed to Donald J. Trump; Anti-Trump Effort Dealt Crippling Blow
(New York) July 11, 2016 Senior United States District Judge Robert E. Payne today ruled in favor of Trump campaign delegates who had argued in line with overwhelming public opinion that RNC delegates must follow election results and that delegates cannot be stolen at the national convention. Delegate Beau Correll, Jr., had brought the suit against the Commonwealth of Virginia hoping to reject the will of the voters, but was soundly defeated.
Specifically, the Court found that RNC Rule 16, which binds delegates based on their election results, is in effect presently and that it controls the allocation and binding of delegates as to their voting at convention. (p. 6) The Court held that the Plaintiffs expert testimony from Erling Curly Haugland was not credible, lacked textual support, (p.6) and that delegates are bound by RNC Rule 16. (p. 7)
Further, the Court found that by signing the Declaration and Statement of Qualification, RNC delegates are bound by RNC Rule 16(c)(2) (p. 10), and that this Declaration obligated Correll to vote in accordance with Republican Party rules and Virginias election results. (p. 46)
Trump Campaign Attorney and former FEC Chairman Don McGahn issued the following statement:
"The court has confirmed what we have said all along: Rule 16 is in effect and thus delegates, including Correll, are bound to vote in accordance with the election results. The court did not buy what Curly Haugland was selling, and noted that his testimony has no support in the rule's text and was contradicted by his own book, Unbound. This case puts his unbound theory to rest, and is a fatal blow to the Anti-Trump agitators.

The Ruling not only had no effect on National and State Party Rules the Judge ruled delegates were required to follows the RNC rules on bound delegates.
But we already know the law and/court orders are meaningless for everyone except the little peons.
What’s that they say about that and two dollars will get you a cup of coffee...
Booyah!!!
Ping :)
RINOs are really just democrat lite.
Pull the thread - it’s causing heart attacks.
Evil seems to lose quite often to Trump.
of course. Are these Cruz people. Can I ask the Trump delegates to boo that bastard off the stage. I am sick of this lying loser. Go Greg ABBOTT!!
BWAHAHAHA
How can the prior post be so wrong?
Only because Rule 16 is still in effect from 2012.
That was the only firewall.
If the Rules Committee changes Rule 16 and the 2016 convention approves the change, then what? No firewall.
That is why this ruling is egregious.
There was no issue of Constitutionality for Correll.
The VA. primary was held on March 1st.
Correll ran for election as a VA delegate in April, 2016, when the results for fully known that he would be bound to Trump.
Then he complained about his rights to free association and to free speech, which was utter horsecrap.
He obviously became a delegate under false pretenses, and since the convention had not been held, there was no harm suffered.
He should have been bounced out of court on his @ss.
The Federal judge had to legally stand on his head to give him standing and to allow him to be heard.
A stay should be requested and Correll’s credentials revoked.
He can litigate again, and by the time it is resolved the Convention is over.
Trump will win by more than enough votes, even if all of VA’s votes are not counted.
Thus the issue is moot.
This is a State matter and the State has a compelling interest to have orderly election primaries and for those results to be properly reflected.
Thank you for updating.
It’s a good thing I’m not going through menopause. Someone would be dead by now.
Understatement. Or just add rage and homicidal ideations. :-)
Thank you, babe. Thanks very much. This is very good news, but will it wind up in a higher court, given the opposing results of two different state courts?
The Virginia court must have been biased against TRUMP?
LOL!!! I’m with YOU!!
Keep Abbott in prayers—in hospital for burn injuries.
