ALBUQUERQUE, N.M. (KRQE) Two people were arrested after a shooting over a stolen truck Friday.
22-year-old Joshua Ortega is facing charges for allegedly stealing a truck and aggravated assault with a deadly weapon, but hes not the only one charged.
The owner of that truck used the cell phone to track the vehicle to a neighborhood near Paradise and Eagle Ranch Thursday. He spotted his truck and called police, but the truck was driven away before they arrived.
Then Friday morning the owner saw the truck again. Thats when the trucks owner, Christopher Martinez, told officers he took out his gun and demanded Ortega give the truck back.
There was a scuffle, and Martinez told police he feared for his life, so he shot Ortega. He was hit in the arm but was not seriously injured.
Martinez says Ortega took off in the truck. Ortega drove to a nearby doctors office on Golf Course seeking help.
Saturday morning in court it was revealed that Ortega has been arrested numerous times this year alone for car theft.
This is his fourth auto theft case in 2016 alone, as well as the pending shoplifting case. We do find Mr. Ortega is a possible danger to the community as well as a possible flight risk, said a court background official.
The owner of the truck and shooter, Christopher Martinez, was also arrested for aggravated battery with a deadly weapon and aggravated assault.

The guy is obviously guilty —
—of showing up the cops as less than competent.
The only state where you would not be going to jail in this situation is Texas.
Here we are allowed to shoot someone fleeing with your property.
I would never do so. But it is good to know the law is on my side if there was ever a grey area.

Seems justified to exercise one’s right of self defense right there...
They should not charge the guy for this.
If they are leaving you in the desert to die...?
If they are fleeing and shooting at you as they leae?
If they try running you over with your vehicle?
Never say never.
Why can’t I get jury duty on a trial like this? I would let the truck owner walk and would push the jury to award the owner for duress and emotional damage.
The fact that he is being charged for attempting to retrieve his stolen property is outrageous.
Any lawyer that could not get this guy off shouldn’t have a law degree. One of the gun rights groups should offer to take his case.
sounds like “there was a scuffle and he feared for his life” so he wasn’t shot specifically over property. I believe he had a right to approach and speak to the driver of his stolen vehicle but it gets murky after that.
What a nightmare for the truck owner who said he feared for his life. This seems to work very well for others. Maybe they have video that shows otherwise.
I will take my chances on any jury in Texas with the exception of Austin, Texas.

People are just getting fed up. It is getting like the wild west out there and authorities want us to sit back and let criminals run wild.
The cops who arrested Mr. Martinez, the truck’s owner, acted stupidly.
Wouldn't be surprised if the thief claims he was afraid for his life !
Yes, in our house the agreement is that we won’t shoot anyone running away with our property. However, confront us with force and all bets are off.
