Baltimore judge scolds prosecutors for withholding evidence in trial of officer in Freddie Gray case

BALTIMORE | The judge who will decide the fate of a police officer charged in the death of Freddie Gray on Thursday blasted city prosecutors for failing to turn over evidence that could exculpate the officer.

On the opening day of the trial for Officer Caesar Goodson, Baltimore Circuit Judge Barry Williams said that prosecutors violated Maryland court rules when they failed to turn over to the defense a discussion with Donta Allen, the second man placed inside the transport van after Gray was injured.

“I’m saying you don’t understand what exculpatory means. I’m telling you that this [evidence] needs to be considered,” Judge Williams told prosecutors. “If you don’t understand that then I don’t know what else you don’t understand.”

If this exposure is proven accurate, the non-actions of the Baltimore “powers-that-be” should themselves be prosecuted. I’d also attach the bill$$$ for the costs of the riots/arson and wear and tear on fire equipment and anything else you could think of.
They could pay it down monthly, we can’t be too tough.

I fail to see how "scolding" will result in justice, but I'm not a lawyer.

Prosecutors have some of the most powerful immunity to prosecution in the entire U.S. system.

The Supreme Court ruled that they can lie, can recruit fraudulent witnesses, can have blatant conflicts of interest, can bring multiple sequential prosecutions (dropping charges just before the case goes to trial, only to recharge later).

It is hard to see that these prosecutors will be held to account.

Scolds?

Had this been a less serious crime like, say a rape/murder of an inferior race by one of ObaMao's people, there would be a lot more than scolding. All charges would be dismissed and the prosecution would be prosecuted to the fullest extent of the law. Maybe even be charged with a hate crime.

Somewhere on the news this guy in the van with Freddie Gray, said this early on in the investigation.... it was reported.
Last night on Fox they were saying they had not heard this before. The guy said it and the reporter said he could not have done this to himself. I didn’t hear it any more after that.

This %&$*@) has already been sued by two officers she chose to prosecute. Wish they could go after her personally, take every last dime as this has cost the officers so much of their lives, their reputations, their time, their families an their money.

Withholding evidence in a criminal matter is very, very serious. Judge should go beyond merely scolding them, and grant a defendant’s motion to dismiss the case altogether. That may happen if the officer’s atty files such a motion. .

There is no jury, just a judge. When the person doing the scolding has absolute power over the outcome, that has to make the persecuted cop feel good.
