That's the problem with her lawsuit.
If she was told that the sperm donor was white and they then used the wrong sperm then she probably has a cause of action for breach of contract, but she cannot prove any damages. The cost of raising this child will be no greater than raising a white child. She is entitled to get her money back and nothing more.
Either way, the child is probably going to need years of intensive therapy, but that is entirely because of the moms.

Holy crow, imagine if somewhere an adopted child sued the agency because of the challenges and obstacles involved in being raised by gay parents.
Yes, no one else seems to be taking in the whole picture of this discussion. This is a reprehensible culture, from "bank" to "customer." No sane society should sell humans like this, but they are.
I've always asked the question from homosexual activists who claim that "having children" is as much their "right" as anything else: What if no one were willing to provide the genetic material your relationship lacks, and no children were readily available for adoption? How would you then exercise this "right?" By force against those who did possess the corresponding genetic material? Why not, when you are forcing much more from us, the violation of our consciences?
Only if the daughter self identifies as a boy or as a turtle or something, I think.
The damage would be done no matter what the race of the child since this selfish person chose to give conceive a baby without providing the child with a proper home.
The child is cute.
She should sue herself for stupidity - for even using a sperm bank.
That was my thought. The child would probably be better off put up for adoption.
Hopefully there are some decent grandparents who will nourish the child.

Oh I agree with just paying her the money back and that is it. Mental anguish and all that stuff which are not tangible are the bane of medical lawsuits.

We had to get a zip tie-device inserted around wife’s cervix, or something (”cerclage”). Took one hour, cost tens of thousands of dollars.
This latest egg “took”, and we are now 31 weeks pregnant, which is as far as we’ve ever gone, and the docs say certain windows of risk are past us now (Last time doc mocked me during the ultrasound: “Yes, the brain is STILL in side the skull”).
I will never own a boat or a cabin in the mountains or a big RV, because I put all that money into conceiving a child, and that’s perfectly OK by me.
Unlike with a child, I won’t lay on my death bed and regret that I never had an RV.
A lesbian should not be giving birth. She can't procure for herself a husband, why should she procure a child?
The sperm donor thing bugs me also. How can you give away your seed, and not even care in the least about what woman it's going to and the child produced as a result?

We absolutely have to have a caesarian, and the doctors take the baby out a little pre-term because of that, so it won’t be a surprise for us when it hapens.
