Former AG on Clinton emails: 'Gross negligence is not a defense’ (Mukasey)

A former George W. Bush administration attorney general on Monday said Democratic presidential front-runner Hillary Clinton has no excuse for using a private email server while serving as secretary of State.

“Hillary Clinton put classified information on a server that was not secure,” Michael Mukasey said on Fox Business Network . "She caused it to be put there.

“Going further, if it’s information that relates to national defense, whether she acted with gross negligence is not a defense. In fact, that’s the standard under the law. That’s a felony.”

President Obama on Sunday said Clinton had not jeopardized national security with her technology habits at State.

“There’s a carelessness in terms of managing emails that she has owned and that she has recognized, but I also think it’s important to keep this in perspective,” he said on "Fox News Sunday." "This is somebody that has served her country for four years as secretary of State and has done an outstanding job.”

Mukasey on Monday said Obama’s analysis of Clinton’s email decisions had not strengthened her case.

“He didn’t really do her any favors by saying she was negligent,” he said on "Cavuto Coast to Coast." "I think he was trying to appeal to what he thought is people’s misunderstanding of the law.

“I’d like for somebody to ask his press secretary whether he’s getting regular briefings on the investigation,” added Mukasey.

“I seriously doubt that he is. If he’s not, then he’s talking through his hat. He doesn’t know whether national security was compromised or not.”

FBI Director James Comey said last week his agency is in no rush to conclude its probe of Clinton’s email server before the Democratic National Convention in July.

The FBI began investigating 22 of Clinton’s emails in February, double-checking the classification status of the messages during her tenure at State.

At issue is whether the emails should have been classified the highest level of “top secret” before they were sent, or if that information was given that status after the fact instead.

How do you re-classify something as top-secret AFTER you release it ?

What do you do- tell everyone to forget they’ve seen it?

Has anyone EVER heard of reclassifying material AFTER its released? Look at the mental gymnastics they have to do to try to make her seem JUST STUPID and not criminal.

But the controlling statute is ObamaLaw which reads that it is not an offense to put Top Secret SCI files on your personal computer as long as you are pretty sure they are not being read by any foreign Intelligence Service.

Exactly, I saw 0bama espousing 0bamaLaw on the video of him with Chris Wallace saying some secret docs are more secret than others. That’s a real head shaker.

An outstanding job doing what? Showing up for work every day? Boarding the State Department airplane when she was told she had to take another trip? What effort did it take for her to do anything she did? Sobering up before she boarded an airplane or went to her office? Please someone just name ONE THING she did that was outstanding. Even Feinstein can’t think of anything she accomplished but Mukasey thinks she did an outstanding job at it? These people aren’t even on the same wavelength as the rest of us. Their logic, common sense and brains are deposited in a dumpster outside DC when they are selected/elected to represent us. WE cheer for the good guys in bringing about justice. These people cheer for the bad guys...

How about we stop with this type of negativity? This rolling over with our tail between our legs like a mongrel dog that has been whipped is a prime reason that nothing may not happen to her. They know that we have become complacent and will tolerate all manner of criminality up to and including espionage at the highest levels of Government.

Its about damn time that it stop.

I agree. People who post, “HRC will skate” are as much to blame as HRC because they broadcast their acceptance that this country is lost. If you really believe this country is lost for good, please stop posting on free republic. (Why do you bother, anyway?)

Thanks for that. I’m glad it wasn’t Mukasey as that disappointed me. I THOUGHT he was a smarter man than that. Anymore there is more PC talk than honest to goodness, genuine sincerity in remarks made by anyone in or who has been in government so you never know...

I cringe at every email or conversation that I have with someone who says the same thing - nothing is going to happen; she’s going to get away with it blah blah blah. I don’t know where it came from but I’m superstitious and if something is said, it’s going to come true. I tell my email friends to PLEASE STOP...

I’ve badgered my husband about this for years and years...When he said, “I’m surprised the battery in your car has lasted this long” - guess what happened next? Dead battery in the parking lot at my daughter’s school... I guess it came from my father as he was a firm believer in never turning the car around to go home if my mother said she forgot to turn something off - iron or whatever! Bad things would happen if he did go back. He was an Irishman and he sputtered of course but he did turn around.

I actually think that hating when people predict HRC will suffer no consequences from having her private server isn't about being superstitious (although I do get what you mean). Every time people on the right publicly say, “HRC will get away with it”, we are also saying, “We ACCEPT that she will get away with it”, which sends a message. If Obama et al expect that there will be no real outcry if HRC is not indicted — because conservatives NOW are shrugging their shoulders and predicting HRC will “skate” — they'll figure they have nothing to worry about by letting Hillary get away with it. We SHOULD be saying, “From a legal perspective, it is inconceivable that HRC will get away with this.”

Freepers who “know” HRC will “skate” should find another story about which to comment, and the rest of us should start telling them that — every single time they post their destructive negativity.
