Ted Cruz wins citizenship case in Pennsylvania Supreme Court

HARRISBURG, Pa. - Texas U.S. Sen. Ted Cruz has won a case in Pennsylvania's highest court that had challenged his eligibility to appear on the state's GOP primary ballot and serve as president.

The state Supreme Court order Thursday upheld a lower-court judge's decision to dismiss the case.

A Pittsburgh resident and registered Republican voter, Carmon Elliott, had argued that Cruz isn't eligible to run for president or to appear on Pennsylvania's April 26 primary ballot because he was born in Canada....

I don’t believe Mr. Obama’s eligibility was ever adjudicated. Cruz’s has been decided in numerous states.

No. It does not mean that. If Cruz gets the nomination, democrats will file federal cases. I read that Alan Grayson said he has one ready to file if that occurs. Get used to it. I do not see how Cruz can be US NBC when he was in fact born a NBC Canadian. I am guessing the issue will be moot as he will not be the nominee but if he is the nominee, there will be legal stuff going on. You can bet on it.

Seems as though someone born in Saudi Arabia to an American citizen who never sets foot on American soil can qualify to run for the United States Presidency. Even though a person with this background would owe their allegiance to their home country Saudi Arabia.

This does not seem to be a well thought out opinion. The court made up their own definition. There will be repercussions to this if it stands. We shall see.

Irrelevant. Unless the USSC says something about it, it will still be used against Ted Cruz by the Democrat PACs during the general election cycle, if Cruz is fortunate enough to be involved in that.

By the way, I'm a Trump supporter who is convinced that Ted Cruz is eligible.

So any characterization that this issue is only an issue with Trump supporters, or that all Trump supporters think Cruz is ineligible, is inaccurate.

There have been plenty of non-Trump supporters on this forum that have been tirelessly pushing this Cruz eligibility thing for almost a year.

In reality, the issue is boob bait for bubbas, IMHO, but that won't stop the Democrats from trying to raise it during the general election cycle, if applicable...

The trial court decision was by Judge Pellegrini. Link again ...

On Judge Pellegrini's Opinion that Cruz is a Natural Born Citizen

Elliott appealed the loss to the Pennsylvania Supreme Court. The appeal (file) includes an interesting amicus brief by Einer Elhauge. Einer Elhauge argument on SSRN, which I think was modified slightly before being filed in the appeal.

The Pennsylvania Supreme Court issued a finding of probable jurisdiction, which triggered the filing of briefs by opposing sides, and this Order, and nothing else.

You summarize it pretty well but I see it as a stamp of approval for the North American Union.

We now have a citizen of Canada running as president.

How long before we have a citizen of Mexico running as president?

And voila, precedent now says anyone can run for president of the US. Conservatives are really special aren’t they?

In 1874 the U.S. Supreme Court ruled in Minor v Happersett that “the Constitution does not say in words who shall be natural born citizens. Resort must be had elsewhere to determine that.”

Well not exactly:

A Commonwealth Court judge first ruled against Elliott’s lawsuit March 10, declaring that a natural-born citizen “includes any person who is a United States citizen from birth."

Elliott then appealed the decision to the state Supreme Court, which issued an order Thursday denying his appeal.

So Commonwealth Court Judge Dan Pellegrini's ruling stands. He is a Democrat who ruled that a natural-born citizen “includes any person who is a United States citizen from birth.” So that means Jose born to 2 illegal immigrant parents is now a natural born citizen. I guarantee any Democrat judge who hears the case will rule in Cruz's favor, just so they can nail him in the general election.

If you believe Pellegrini's ruling of what a natural born citizen is, then we are doomed and the Constitution as the Framers created it is a dead document.

He's not. But, what people lose sight of is that the courts don't care about the law, when the law stands in the way of progress (as in "progressive"). I do agree there will be legal stuff (court action) going on, but the courts are not going to apply precedent to this case. The public at large won't know the difference.
