The most important news out of this interview is NOT whether Stone planted the story. It is NEWS that he “know’s for a fact” that Cruz had sex with those women.
If Stone really has proof, he owes it to the country and to the Republican party to bring it forward so the cat-fight between Trump and Cruz would end.
Cruz would have to withdraw and Trump could proceed to the coronation as the nominee without any further ado.
I’d like to see this nonsense over, so come on Stone, lay it out for everyone to see.
The way Stone phrased his statement leaves little wiggle room-—it’s a dare for Ted to sue and bring discovery into play.
Stone knows these things:
1.Any lawsuit would take too long to give any recompense in money or favorable publicity during the campaign;
2.A lawsuit would simply give more publicity to the charges
3.a public figure under the standard of New York Times Co. v. Sullivan, is required to prove “actual malice” —i.e. that the defendant published the item either knowing that it was false or with reckless disregard for whether it was true or false—on the part of the Enquirer by “clear and convincing evidence”.
The lawyers at NE are very used to these suits because the NE so often crosses the line between fact and innuendo. The NE article was very careful to avoid declarative words like “we have the proof for our article’s charges.” Instead they avoided any liability by using “rumors” “alledged” “heard’, “supposedly” etc.
I expect Stone to give the proof if he can. Might as well get this over with and proceed with a candidate against Hillery, no?
