Burns, OR - An FBI agent is suspected of lying about firing twice at Robert "LaVoy" Finicum and may have gotten help from four other FBI agents in covering up afterward, authorities revealed Tuesday.
The bullets didn't hit Finicum and didn't contribute to his death, but now all five unnamed agents, part of an elite national unit, are under criminal investigation by the U.S. Justice Department. Inspector General Michael Horowitz is leading the independent inquiry.
The remarkable disclosure came as a team of local investigators released findings that two state troopers shot Finicum three times in the back during the chaotic scene at a police roadblock Jan. 26. One bullet pierced his heart, an autopsy showed.
A prosecutor ruled the fatal shooting was legally justified, saying state law allows use of deadly force when officers believe a person is about to seriously injure or kill someone. Finicum kept moving his hands toward a pocket that contained a loaded handgun. Although he was shot from behind, Finicum had a trooper in front of him armed with a Taser who was thought to be in danger.
Finicum, 54, an Arizona rancher, was one of the leaders of the Jan. 2 takeover of the Malheur National Wildlife Refuge near Burns.
Investigators gave no details to explain why the one FBI agent, a member of the Hostage Rescue Team, wouldn't report the two shots. They also didn't indicate what his four colleagues on the team did to warrant investigation other than saying it was related to conduct after the shooting.
The moment that matter happens at 5:30 in the video. Lavoy gets out of the truck with his hands up and says “go ahead of shoot me”. At this point the FBI agent who denied firing fires 2 shoots to kill Lavoy. They miss him and strike the truck and back window(which is why they can’t find the “2nd bullet” because it passed through the window) Its clear that that FBI agent was assigned with a kill order and the rest of the FBI in the group knew it. Its pretty clear cut at this point that it was murder... between this new evidence and them rounding up the people that took part in the first bundy ranch stand off, if the militia doesn’t strike back they will be run into the ground. Guess the ball’s in the militia court now.
Most on FR felt this was not a “pure” enough cause.
I guess that means it will be OK that the F.B.I. killed this crazy, misguided soul.
Lesson, don’t get involved with anything, there are always excuses that your back will not be covered. Better take a vote first to make sure it is approved.

They looked like they wanted to massacre everyone in the car. The occupants played it smart to stay down and cool while they were shooting at women and children.
He repeatedly stated that he wanted to talk to Grant County Sheriff Glenn Palmer. Everyone knew this before hand. Everyone knew about the travel plan beforehand. If LEOs wanted to avoid bloodshed, they should have had the sheriff at the roadblock. Everyone would likely have surrendered peacefully.
Ya, I remember him saying something about not a hill to die on. Something about a trap perhaps. It’s possible be knows something I don’t, but I think the time to act was long ago. Everyday we wait, they get stronger.
Observation. The folks that showed at the Bundy ranch and federal holding pen for the Bundy livestock took a stand and the feds appeared to have backed off. They then seemed to celebrate they'd won a standoff with the feds...am I right? They then all traveled back home thinking a job well done. Didn't any of them reason that the feds would come for them? Analyze video/audio footage to gather intel om lic plates, faces, names to investigate/issue warrants?
When Americans take a bold step such as this, the feds are not just going to forget about it. They will come. They will come in the early morning hours in full force for every single one of’m. They now have about 75 arrest between both incidents.

I thought so too but now I can see well enough and hear well enough to tell this was murder by cop not suicide by cop.
Five Swat guys pepper the vehicle with semi-auto assault rifles, and no one inside is even injured.

He yelled a lot about “shoot me”. They complied. I’m inclined (objectively correct me where I’m wrong) it was both an ambush _and_ suicide by cop.
