Keep Your Eye on Convention Rule 40

BEGIN TRANSCRIPT

This is from The Politico. "The only way Republicans can stop Donald Trump from capturing their party’s presidential nomination will be if they go to the July party convention without a clear standard-bearer. Virtually every GOP member of The POLITICO Caucus -- a panel of operatives, activists, strategists and elected officials in four key March-voting battleground states -- said after Super Tuesday, the door has closed on the possibility of another candidate winning a majority of delegates."

....

However, they can change rule 40 the day before the convention. That's also in the rule! Rule 40 basically says what it says today, and has the provision that they can rewrite it and say whatever they want it to say the day of the convention or the day before. (interruption) Well, it's their convention, Snerdley. It's the Republican Party's convention. They can write whatever rules they want. And they have given themselves all kinds of outs and latitude and leeway to write new rules whenever they need them. (interruption) It's exactly right, why they don't trust -- and this is what Cruz is talking about. If they start messing around like this, it's all over.

(b) Each candidate for nomination for President of the United States and Vice President of the United States shall demonstrate the support of a majority of the delegates from each of eight (8) or more states, severally, prior to the presentation of the name of that candidate for nomination. If the GOPe pull any shenanigans, especially by rewriting the rules, there will be a civil war. Trump and/or Cruz should run independent or third-party campaigns. If the Republican voters are ignored at the Convention, then the Republican Party should not exist. The top two finishers will be Trump and Cruz. If nobody receives a majority of the delegates, the Presidential nominee should be one of them with the other being the running mate.

Trump is the only GOP candidate that can win the nomination. He will get enough votes to win, but all the other candidates currently running, to include Cruz, will be used to hamstring him prior to going into the general.

Hillary Clinton is suppose to win. Now all you rabble rousers need to fall in line.

If the GOP does this, I would hope that Republican turnout in November would be measured in the thousands. Not “tens of” — just “thousands”.

The GOPe’s best shot at survival seems to me to make a deal with Trump. Agree to knock off the BS and not to fight him for POTUS but he’s got to raise his own money. That would allow them to focus on keeping the House and Senate majorities. If they push a brokered convention they might well end up with nothing.

You have a great idea! People should plan ahead and buy plane tickets and hotel rooms well ahead of time. Take time off from work. If you are retired you have all the time in the world. :^) Planning is needed be prepared. How about a people’s convention in Cleveland ?

Never negotiate with traitors and treasonists. It’s in the Constitution . . . probably, somewhere . . . and if not, it should be.

Changes to the Rules are actually provided for in Rule 41.

RULE NO. 40 (from 2012)
Nominations

(a) In making the nominations for President of the United States and Vice President of the United States and voting thereon, the roll of the states shall be called separately in each case; provided, however, that if there is only one candidate for nomination for Vice President of the United States who has demonstrated the support required by paragraph (b) of this rule, a motion to nominate for such office by acclamation shall be in order and no calling of the roll with respect to such office shall be required.

(b) Each candidate for nomination for President of the United States and Vice President of the United States shall demonstrate the support of a majority of the delegates from each of eight (8) or more states, severally, prior to the presentation of the name of that candidate for nomination. Notwithstanding any other provisions of these rules or any rule of the House of Representatives, to demonstrate the support required of this paragraph a certificate evidencing the affirmative written support of the required number of permanently seated delegates from each of the eight (8) or more states shall have been submitted to the secretary of the convention not later than one (1) hour prior to the placing of the names of candidates for nomination pursuant to this rule and the established order of business.

(c) The total time of the nominating speech and seconding speeches for any candidate for nomination for President of the United States or Vice President of the United States shall not exceed fifteen (15) minutes.

(d) When at the close of a roll call any candidate for nomination for President of the United States or Vice President of the United States has received a majority of the votes entitled to be cast in the convention, the chairman of the convention shall announce the votes for each candidate whose name was presented in accordance with the provisions of paragraph (b) of this rule. Before the convention adjourns sine die, the chairman of the convention shall declare the candidate nominated by the Republican Party for President of the United States and Vice President of the United States.

(e) If no candidate shall have received such majority, the chairman of the convention shall direct the roll of the states be called again and shall repeat the calling of the roll until a candidate shall have received a majority of the votes entitled to be cast in the convention.

Don’t worry, if Hillary loses to Trump, she can run again in 2024!

Her freshness date never expires!

If the GOPe uses Rule 40 to “engineer” the nomination, then the base should invoke Rule 303.

I believe that this will be the shape of the race after March 15th.
1. Rubio and Kasich will be dead. Neither will be viable. I had heard the report that Ted has opened headquarters in FL. What might be going on is that Ted is strategically trying to siphon votes off from Rubio. Baring a “hail Mary” Rubio is not going to beat Trump. Rubio will have to drop out. Ohio is a different matter. The spread is much closer there and Kasich might pull it out, although I don’t think so. If he does the establishment gop will pour everything into his campaign. But like I said, I think he loses and drops out.

2. This will leave a two man race. Cruz will grow and win some states. He will probably pick up Rubio’s delegates. This being the case, I think that both will go into the convention short. Trump will probably be close to a 1,000 delegates and Cruz at about 800.

3. Does the GOPe hate both Trump and Cruz so bitterly that they will pull some underhanded trick? The only thing that might preclude this if the rule change is fought on the floor and the Trump/Cruz force join and stop it.

4. If there is some underhanded trick, there will be a bloodbath, prompting both Trump and Cruz delegates to walk out.

5. If, in the midst of this insurgent year, someone like Bush or Kasich is forced upon us, Trump and Cruz needs to join forced and run as a third party ticket. I think that in this kind of atmosphere it would have the first real chance of victory for a third party movement since Teddy Roosevelt and the “Bull Moose” Party.

Anyone with any thoughts?

Why is Ryan automatically the Chairman of the convention?

I thought first order is to ELECT the chairman and THEN adopt the new rules.

What does majority mean in rule 40? 50%plus in a state or the highest vote total?

Will anyone have 8 states with 50% plus vote total?

I don’t think Trump has any states with 50% plus.
