(CNN)A high-speed getaway attempt and a reach for the waistband are said to have prompted police SWAT team members to open fire on a group of leaders of the Oregon armed occupiers.
A law enforcement official described the dramatic showdown that occurred Tuesday night on a desolate stretch of U.S. 395, some distance away from the federal wildlife refuge where the group took over federal buildings nearly a month ago.
FBI and Oregon State Police at a command center in Burns were monitoring the group when they departed the refuge to attend a town hall meeting with local residents in the town of John Day.

If it provides the optic to support the government narrative, we’ll see it.
They want to avoid a bad optic which could include him not being a threat. Jumping out of a car and running is not a capital crime.
I’ve tried to be even keeled, when reading stories about this group...but this caught my eye:
“...reach for the waistband...”
Last week, Finicum was involved in taking an alleged spy camera off a pole (and I have been critical of it, since it was just the power company’s camera). But in the video of that episode, it is clear that he open carries a large pistol in a holster.
Maybe the video will clear things up...but I’m not yet ready to automatically accept the ‘reached for his waistband’ story.
In McConnell’s own telling of events, he is really re-telling the story of a 19 y/o who was with Finicum (Cox I think). His story has always been third hand.

True, but in his testimony I thought he said Finicum charged the officers, no?
The testimony of the choir girl in the car carries much more weight with me. Just the emotion in her voice tells a story.
Anyway, for me, this would seem to indicate that Mark could not see the events unfold.
Just an observation. Another was the “reaching for the waistband”. That seems like and awfully ghetto way for a cowboy to carry his sidearm......
Would be good to see vid. Possible mistakes w/reaching for waistband:
1) If he did it as soon as he got out, maybe he was just pulling his pants up a bit, as I usually do when I first get out of the car.
2) By the waist is where your hands are at rest. Was he getting out and just not putting his hands up or was he actually going for the gun? They say the ordered him to surrender. Nothing about hands up, but that could just be an editorial omission.
Regardless, it’s usually a good idea to simply sit still if submitting to arrest to avoid quick trigger pulls. Unfortunately, the 2nd amendment has been so demonized, people think that just having a gun in the vicinity means you’re shooting at them.
In this case, his prior statements about not allowing himself to be arrested didn’t help. Being ready to fight at the park probably didn’t help the mentality either, but that was only because they felt a need to defend themselves from a Waco style hit.
The biggest problem I see here is that the article didn’t mention that any guns were recovered. May be an editorial omission.
To be arrested in this situation, for future reference, if I get out of a vehicle, I’ll keep my hands on the door!

With all those “sharpshooters” and all surrounding him I’m sure he he could have been shot in the shoulder instead center of mass.
Another thing to consider is why did the other guy get shot in the arm? Was he reaching also?
He would not have been standing next to the one killed if it happened as soon as he exited vehicle. Ricochet? Would have physical evidence of that in vehicle. Something to keep an eye out for in future releases.
I’d guess there are multiple videos.
My advice: wait for the video(s) before judging and reaching conclusions.
High speed vehicle escape attempts to avoid arrest by armed and amped up police/FBI agents are not likely to end well for the perps.

I have been around these types of folks (western ranchers and cowboys) for a lot of my adult life.
I do not know one western rancher who carriers a handgun on his waist. Invariably they (myself included) have holsters when we are out in countryside.
So I question the “reaching for the waistband” story to begin with.
I will wait and see the video. But the longer it goes without us seeing it, the more questionable it will become.
Mark’s video is telling...but he was not at the scene of the shooting, and he was also not a member of the original group of people, or one of the leaders.
The girl’s story is highly emotional...but at her age and with what happened, that is understandable.
Were they being shot at as they tried to get away? Why would the Feds shoot when they knew there was basically an impassable road block just up the road? Was that vehicle literally riddled with bullets in the end?
I want to see that second vehicle. If it is riddled with bullets, then that will lend a lot more credence to everything she said.
We know Ammon’s brother was in that vehicle and he was wounded...so some rounds clearly went into that vehicle.

“3. Economy of explanation” in this case would seem to be that the law enforcement people would have immediately come out and said that he came at them with guns blazing and that’s why they had to shoot him.
They have been switching stories and coming up with lengthy explanations.
They do not pass The Tests Of Truth.
“Traffic Stops” on a 40 mile stretch of barricaded highway ALWAYS have A couple dozen SWAT TEAM Sharpshooters on hand. Good thing Fido stayed in his kennel that night.

Exactly...this was not a “routine traffic stop,” in the least. It was an ambush, and they were there waiting for them to come along.
I suspect that the Harney County Sheriff, Ward, whom I watched during his arrogant news conference yesterday, lured the Bundys out with a promise of some kind of safe passage to John Day.
Nothing else makes sense. But I never would have trusted that guy. He has been angry, mad, and looking for an opportunity to get these ranchers from the get go.
The wounding of the Bundy brother is initial corroboration of the girl’s story. Absolutely.
I actually heard on one of the cables this morning (CNBC, MSNBC or CNN) that Finicum exited the vehicle armed, and I think the announcer used the word aggressive, too.
I don’t believe it. The girl says Finicum was talking to them. This NEVER would have happened to protesters in Baltimore or Ferguson. Never.
