Deschutes County Major Crimes Team is investigating the officer-involved fatal shooting of Robert "LaVoy" Finicum.

1:30 p.m. (PST): The courtroom is full, including the jury box, a U.S. Marshal said. About 20 still in the line won't make it inside.

Washington Post (and Wikipedia) is still referring to a “shootout”

Not sure why when every indication is there was no exchange of gunfire.

Remember in the old days Sheriffs didn’t shoot someone just because they had a gun?

2:06 p.m. (PST): Tim Smith — a Burns-area businessman and member of the Harney County Committee on Safety, a group of six local residents formed at the urging of protest leader Ammon Bundy — called the deadly confrontation outside of Burns “very unfortunate” and said federal authorities should disclose exactly what happened.

He said he knows the spot where the shooting occurred, an area 20 miles north of Burns in Devine Canyon along U.S. 395, and described it as a scene out of “an old western movie.”

“This is pretty upsetting for everyone,” Smith said.

But the committee still expects to take up Bundy’s cause, he said. “We’re going to continue to do what our goals have been,” he said.

Bundy has said the occupiers of Malheur National Wildlife Refuge want two local ranchers freed from prison and local control of federal land in Harney County.

While endorsing the attention that Bundy brought to rural issues, Smith and the local committee members asked Bundy and his group of out-of-state protesters to leave the refuge and Smith repeated that Wednesday. A small group of people are believed to remain at the bird sanctuary about 30 miles southeast of Burns.

“For their sake, I hope they go home. ... We asked the Bundy group to go home a long time ago,” Smith said.

“Shoot out?” Doesn’t that imply two sides shooting?

So far that I have read, from Leos is that they fired the shots.

Maybe I missed the report...

With ALL the time the Feds had setting up the ambush site, and with ALL the hullabaloo lately from blacks about body cams for cops, and ALL the advance warning and planning time in Oregon, the Feds should have NO trouble turning over video of the so-called “shoot-out” that supports their narrative. If they DO NOT (or CANNOT) produce the video, that constitutes PRIMA FACIE evidence of Federal culpability in murder. Q.E.D.

I thought I read that Finicum made a point of NOT carrying a gun during this direct action of occupying this nature center or whatever it is that has the feds panties in a twist. If he DID have a gun, he had a right to have it. Maybe the federal marshals and feebies involved in this persecution should be re-assigned to useful work protecting all of us: airport surveillance to thwart attempts by Muhammed el Kaboomski or whomever to infiltrate our country and blow up our citizens. Oh, that’s right! Obozo is STILL POTUS. Just 359 days, 19 hours and 14 minutes until our long national nightmare is over, but, who’s counting?

When the victims don’t even want to put up a fight, you can bet your plan to free the people is ill-conceived. Wrong fight all around. They’re too far gone to care what the gub’mint does to them.

3:20 p.m.: The arraignments are over. Ammon Bundy and six others appeared one at a time before the judge. Bundy’s appointed lawyer to issue a statement soon. Other defendants had court-appointed attorneys. The judge found each to be a serious flight risk; prosecution said it feared they might return to Malheur refuge for a last stand.

Ryan Bundy, Ammon’s brother, appeared relaxed, asked courtroom gallery “How are you?” when led in. Asked judge the same.

The complaint against the seven ran 31 pages.

Bundy, through his lawyer, told the remaining occupiers to “Please stand down” and go home.

3:55 p.m.(PST): The arraignment is over. Ammon Bundy and six co-defendants will return to federal court for detention hearings on Friday at 1:30 p.m. They remain in jail in Portland for now.

The federal complains cites the extensive Facebook posts by Bundy and others about “tactical camping,” alleged threats of following people home.

They certainly need to deploy a lot of assets to deal with a handful of lightly armed men who have made no overt threats.
