Texas Sen. Ted Cruz (R-TX)97% has repeatedly defended his eligibility to be president this week, but wondering whether his Canadian birthplace would prevent him from running for the office has been on his mind since at least childhood, a classmate of his tells CNN.

When Cruz was running back and forth to Canada as an adult, was he taking advantage of any benefits due him as a Canadian born person, like using the Canadian health care system?

If Cruz as an adult used the free health care in Canada on the basis of his being born in Canada, then it shows he identified as a Canadian citizen.

So I guess the question is, how did Lubetsky know Cruz was a dual citizen and yet Cruz-- supposedly sitting there ignorant, not hearing anything his buddy is saying-- did not?

Two questions here: as to the first, I assume that Lubetsky, being 100% Canadian born and raised would be more familiar with Canadian law and custom that would be Cruz, a Texan. Lubetsky, knowing the facts of Ted Cruz's birth and life, would perhaps know that Cruz was in fact a dual citizen even if Cruz was not. Cruz himself apparently always referred to himself as an American when crossing the border (and we have no idea whether this was commonplace or not).

I am not sure what would have inspired this Lubetsky to volunteer that Cruz was a dual citizen, but it isn't hard to imagine that he blurted this out after hearing Cruz identify to the border crossing official as an American.

Cruz himself would probably not have wanted to escalate this offhand remark, possibly complicating the border crossing and therefore would have shrugged it off as an inconsequential remark. I know I would have.

As for what Cruz heard or did not hear, or what importance he might have given it, I wasn't there and I have no idea.

i only know that it is a matter that is of ZERO consequence to me, any more than Trump's own possible dual citizenship at birth. Its nonsense.

I wasn’t born in Canada and I have used the Canadian “free health care system”. So what?

What does that prove?

And anyway, do you have even the slightest evidence that Cruz - as an adult - used the free health care system in Canada in the first place? I doubt it.

TED CRUZ is by far, the MOST CONSERVATIVE CANDIDATE we've got ! Here's the supporting article from Ilya Shapiro, a senior fellow in constitutional studies and editor-in-chief of the Cato Supreme Court Review.
Like most immigrants, he does a job Americans won't: defending the Constitution.

Not sure it’s nonsense..

Obama was NOT eligible to run for the presidency because he was born outside the United States to a non-citizen Kenyan father and a mother (citizen but less than ten years).

There was a case a few years before Obama’s birth that made it clear he would NOT be even considered a citizen:

Obama’s mother came to Hawaii and, after the fact, obtained a birth certificate to complete the fraud.

That’s the BC we had months of controversy over that was never produced. Instead we got a made up document by the Hawaiian authorities.

Did you miss the entire ‘birther’ issue?

I actually believe in the rule of law and the Constitution. This is a serious issue.

I like Cruz’s policies. I hate Obama and voted against him. Twice. Campaigned against him.

But for those interested in what American law says about the issue of “natural born citizen” I’ve posted the links. I’m not attacking Cruz specifically. Nor will I ignore Constitutional issues for ANY candidate. I’m not a hypocrite.

So it’s an issue courts will decide.

Let's look at the sentence again:

Lubetsky said he remembered one occasion at a border crossing where Cruz identified himself as a dual citizen, "because I pointed him to and said he was a dual citizen."

The "because" is only an explanation of why Cruz identified himself as a dual citizen. This contradicts your assertion that Cruz didn't "notice." Thus, the student's recollection of Cruz is not invalid.

Also, when the student says it was Cruz's "routine" to identify as an American, it does not restrict the meaning to "always," just "usual" or "almost every time" at best.

1. Where’s the birth certificate for Cruz’s mom? Please produce that for me as the Cruz campaign has not.

2. Cruz’s parents lived for EIGHT years in Canada. Did his mother file tax returns for the U.S. during that time?

3. Did Cruz’s mother ever renounce her U.S. citizenship?

4. Did Cruz’s mother ever visit the U.S. Embassy in Canada to register Ted as a U.S. Citizen?

5. The process by which a parent overseas gives birth to a U.S. Citizen baby is one of “Naturalization.”

The USSC has said “naturalization” while conferring citizenship, is distinct from being a natural born citizen, which entitles one to run for President.

Here are some legal cases to check out, if you’re so inclined:

in Rogers v Bellei, Montana v Kennedy, Zimmer v Acheson

We pointed out years ago there was a serious problem with Obama’s eligibility and were ridiculed wildly.

The Constitution (I hear) is still the law of the land.

So this is a big issue. I’d expect the Court now though to allow anyone and everyone to run for Presidency, but we will see.

Also, since I was NOT there, I did not make any assertion as to what Cruz did or did not do or say. So, don’t try to put words in my mouth.

The only assertion that it did make is that this is a matter of ZERO consequence, and that I reassert now.

He would go to Canada with the Princeton debate team. I doubt he had need to use the healthcare system.

Also each province as their own separate system, and from what I understand you need to be a resident of the province in question to be eligible for their healthcare. So just because Cruz was born in Alberta, he wouldn’t have birthright to Ontario’s healthcare, but he does have birthright to be President of the USA ;)

The process by which a child of citizen parents becomes a citizen of the U.S. is NATURALIZATION.

You are profoundly confused (if not actually disturbed).

Cruz arrived in the world an American because of his mother. Any consular bureaucratic procedure surrounding the event was just to confirm it. It did not make him a citizen. Because he already was, by virtue of his birth.

Naturalization is the process a non-American undergoes in order to become an American. E.g., Arnold Schwarzenegger or Henry Kissinger. Neither man is an American by birth. Being not American at birth, they needed "NATURALIZATION" to become American.

But, unlike Arnold and Henry, Cruz is a natural born citizen and eligible to be President, with no need to be naturalized!

Many of the Supreme Court cases mention the concern of ‘dual loyalty’ for citizens that aren’t “natural born citizens.” Likely why Cruz decided to ax his Canadian citizenship.

Did Cruz actually say as an adult he had no idea he was a Canadian citizen? He obviously knew this his entire life.

IF his mother renounced her U.S. citizenship, he’d have been born to two Canadians (his father was a Cuban then Canadian citizen - later to renounce the Canadian citizenship).

If that’s the case, no doubt he’s not NBC and likely not a U.S. citizen at all.

Who has those records? Aren’t they public?

I cannot believe how crazy this is. A natural born citizen is a person who is automatically a citizen at birth. Like McCain. Like Cruz. Like, currently, anyone born here even to illegal parents, which I do think we should change.

My son was born to me, an American, outside the country. He had his pass from the American embassy within days. His birth certificate is an original, not filed anywhere. He was born an American. The same is true for Ted Cruz. He did not need to be naturalized.
