Trump Playing Both Sides of Cruz Birtherism.
On Thursday, Donald Trump tweeted, ".@SenTedCruz Ted--free legal advice on how to pre-empt the Dems on citizen issue. Go to court now & seek Declaratory Judgment--you will win!"
Trump's tweet is the latest in a series of statements wherein he seems to be simultaneously fanning the flames on Cruz birtherism, and saying it won't be an issue.
On Wednesday, according to CNN, he said, "How do you run against the Democrat, whoever it may be, and you have this hanging over your head if they bring a lawsuit?"
"This was not my suggestion. I didn't bring this up. A reporter asked me this question," Trump said. He also repeated his assertion that Cruz has a Canadian passport, which Cruz denied during a separate interview Wednesday with CNN's Dana Bash.

I’m not sure why Trump is getting flak for raising a real issue.

It’s called a declarative court statement and is common.
With any luck, this would drag Odumbo’s situation into this mess as well, perhaps as an example of precedent, which would then need to be analyzed in great detail.

It is common when there is an actual dispute between actual parties. One party cannot seek an ex parte declaratory judgment concerning his or her legal status.

But where is his CAT scan? Why hasn't it been released? Is he hiding something?

The only problem is that Obama (fake or not) produced a BC that stated he was born in Hawaii.
Cruz has a big old BC clearly stating that he was born in Canada.
We could only be so lucky though.
I think he is doing Cruz a favor. He has taken a lesson from the Clintons. If there is an issue that is going to be an issue later, better to get it done with sooner.The Democrats are going to have a screaming fit about it if Cruz becomes the nominee. Better to deal with it now and let it be old news then.
If it could be established that litigation is about to occur or imminent, I think it could be argued that rights of potentially litigating parties need clarification before actually initiating litigation.
The Cruz people ought to be looking to Cruz himself and demanding to know why this was not effectively nailed down months ago.
It doesn’t matter how mad they are at Trump, this issue is real, unresolved, and would have been the mother of all October surprises if it was just left to chance.
Like what did they think would happen? That the press, Hillary, and the DNC would just let it go?
The only thing the Democrats did was what the GOP should have done in 2008.

Cruz needs a definitive judgement NOW to be considered as VP.
Trump simply tying-up loose ends so no surprises in the general.
.... Good point .... I like the fact that Trump forced this to the forefront now instead of allowing the media to frame the talking points and waiting for a so called "Strategic" moment for maximum effect to escalate the discussion!
.... Cruz needs to be prepared for absolutely any kind of attack including the stupid stuff from the Lame Mushy Brained Media.
