Obama gun control executive order compromises doctor-patient confidentiality for "mental health" issues

Once again, President Obama is circumventing Congress and the Constitution by issuing decrees and implementing them as if they are law. This time, he's going after a fundamental civil right protected by the Constitution: our right to keep and bear arms. Much of the media focus on Obama's executive orders thus far has been on the background checks provisions that would require private sellers of even a single firearm to register with the Federal Government as a "firearms dealer" and conduct a background check on the buyer (even if that buyer is a family member). However, Obama is also prepping an executive order that essentially crushes doctor-patient confidentiality for mental health patients.

While the 1993 Brady law prohibits gun ownership by individuals who have been involuntarily committed, found incompetent to stand trial or otherwise deemed by a court to be a danger to themselves or others, federal health care privacy rules prohibited doctors and other providers from sharing information without the consent of their patients.

Under the rule, which takes effect next month, for the first time health providers can disclose the information to the background check system without legal repercussions.

"The disclosure is restricted to limited demographic and certain other information needed for NICS purposes," the rule states. Disclosure of diagnostic or clinical information is prohibited.

Military Veterans who undergo PTSD counseling will feel the brunt of this, and those brave men and women who fight for our liberties will see their own taken away.

My PCP used to ask if I owned guns. I told him once I do and if he wasn't nice to me, I was going to shoot up his office. He knows me well, so he knew I was joking. And I'm sure he didn't want to ask, but felt he had to. It was part of some checklist which I assume was issued under Obamacare.

A couple of months ago, we went through the checklist again, but I noticed he didn't ask about guns. When I asked, the doctor said he stopped asking because there was some flap involving the NRA.

I think he just got tired of people like me giving him grief.

This has been part of the problem for many years...many servicemembers with security clearances avoided mental health practitioners like the plague. Seeking any assistance from them used to result in automatic suspension/revocation of one's security clearance.

Only in recent years has there been attempts to remove the stigma.

This illegal action by the ahole in chief will only further the stigma and result in less servicemembers seeking professional help in dealing with PTSD...as a result, more suicides.

Eff you 0bama and Lynch (and the GOPe aholes who confirmed the bitch to AG).

Executive orders cannot control anything outside of the Executive Branch. Doctors are not part of the government, so they can just ignore the rules.

I’ve not had any of my healthcare providers ask about guns, but they do harass about smoking. Yesterday, I asked the nurse, don’t you have my medical records in front of you? She said, Yes. I replied, then you already know the answer to that question, right? She replied, We have to ask anyway. Fair enough I said, But *I* don’t have to answer!

Beware if you don’t answer, they can get violent! You see, she had just put dilation drops in my eyes, so she left the room and flipped the bright lights on. When I cried out in pain, she slammed the door!

Good thing she didn’t have a gun! How dare a mere patient defy her authority!

Narcissists are a pita.

Many of you are wondering ,because you are not trained is basic Constitutional law, what the Constitutional infringement actually is when the Doctor takes away your right to obtain a firearm Guaranteed under the second amendment. The answer is— it very clearly violates your 14th amendment right to due process of law. Due process is NOTICE, HEARING, and right to face your accuser. Convicted criminals are afforded that right in trial. If they are convicted of a felony they lose their right to vote and their right to a firearm. Due process.
Now that you understand that, explain how any liberal Doctor can just put you on a list ( Without NOTICE ,HEARING,and the absolute right to face your accuser) and you CAN NOT BUY A GUN ? You have got to be kidding me. These fools wanted to do a “No fly” list to deny you due process by deeming you a “Terrorist”. ( BTW define what a “terrorist” is) These people are NUTS!!

Your verification is that I'm saying it's so.

They don't do it all of the time, and if you're not recording because you don't expect it, well...

Happened when the standard questions were asked during checkin with the nurse.

Questions asked by doctor and also surgeon during follow up from surgery.

I'm also saying that the night nurse at a VA hospital never gave the patients on her floor their pain meds for at least one night that I know of.
And I'm wondering where the narcotics are going.

This is also true.

This is right out of the Third Reich/Iron Curtain police state.
