Camille Cosby to speak on the record: Judge rules Bill Cosby's wife must give deposition in defamation suit brought against him by seven of his alleged victims

Bill Cosby's wife Camille will be forced to give a deposition in a defamation case brought against her embattled husband by seven of his alleged victims.

Camille and her lawyers had filed a motion on Wednesday arguing that she should not have to testify against her husband or share any information from private conversations between the two, but a judge in Massachusetts dismissed her entire motion on Thursday.

This means that Camille is now scheduled to be deposed on January 6 - next Wednesday.

That is patently unconstitutional. In the United States of America a person can not be compelled by the court to testify against their spouse, criminal or civil court.

Not true. There are all kinds of exceptions and depends on the State in State matters.

This is an interesting blurb about law in a different state from 2011 so everything could have changed since then.

“Although many of the cases involving a witness invoking the spousal privilege are in criminal proceedings, a recent ruling in a Pennsylvania civil case has led a federal judge to rule that this privilege does not apply to civil cases. In this most recent case the spouse of one of the parties involved in a contentious litigation asserted the spousal privilege in her deposition, but the Court ruled that the spousal privilege does not apply in civil cases and that the wife could not invoke this privilege in any deposition. However a different privilege, known as the marital communications privilege, does still apply in civil cases. The marital communications privilege prevents a spouse from testifying to what his or her spouse said, not what may have been observed.

Finally, in another recent Pennsylvania case the Pennsylvania Supreme Court upheld the right to immediate appeals of claims of spousal privilege. The impact of this is that trial court orders overruling claims of privilege and requiring disclosure of privileged and confidential materials are immediately appealable – allowing the proponent protection before the cat is out of the bag”

Where, exactly, do you find that in the Constitution?

I can't understand how the judge could rule this way. Is it legal -- wife being forced to testify against her husband? If not, then it seems it's another case of a judge overstepping the boundaries.

Of course, if Camille were honorable, she'd volunteer to testify.

She doesn't have to testify against him. Giving a deposition is just getting out some information - for the record.
