Jahi McMath’s father sues hospital for trying to kill his daughter

OAKLAND, California, December 17, 2015 (LifeSiteNews) – 13-year-old Jahi McMath went into cardiac arrest after a routine tonsillectomy in 2013. Jahi was in oxygen-deprived cardiac arrest for two hours, causing brain damage. Though Jahi lived, her doctors said she was "brain-dead," and UCSF Benioff Children's Hospital Oakland and Alameda County officials issued a death certificate. 

Since Jahi has been declared "dead," insurance no longer covers her health care.

Jahi's mother, Nailah Winkfield, sued Jahi's doctor, Dr. Frederick Rosen, for failing to tell her that Jahi's surgery would be "complex and risky" due to Jahi's susceptibility to heavy bleeding and for failing to share that risk with nurses taking care of her recovery after surgery.

Jahi began coughing up blood the morning after the surgery; the nurses didn't know she had a risk of serious hemorrhage. The nurses told Nailah Winkfield that Jahi's bleeding was "normal." One nurse even used a suction device to clear the bleeding. Eventually, Jahi's heart stopped, causing brain damage.

Now, Jahi's biological father, Milton McMath, has sued as well. 

Jahi caught the attention of the media when her mother refused to take her off life support. The Winkfields removed Jahi from Oakland to New Jersey, where she continues to live and her vitals are strong.

The Winkfields note that Jahi's heart is beating on its own, and her organs are not failing, as would be the case if she were brain-dead. They have released several videos showing Jahi moving and reacting to stimuli.

In October, a judge ruled that Jahi's family could present evidence to determine if she is alive or dead. If dead, the suit would be for wrongful death, with a maximum of $250,000 for damages.

If Jahi is declared legally alive, the lawsuit could be for many millions of dollars.

Best I can tell, people would be on this thread for one of three reasons:

1. Those of us who always believed Jahi was disabled rather than "brain dead" and want to show support.

2. Those who are bitter that their rationalizations for murdering her have proven to be unfounded and want to still push the pro-death agenda.

3. Those who initially supported the "brain death" diagnosis, but now admit that it was hasty and incorrect (for the record, I'm not sure we've seen ANYONE in this category which would indicate that those who supported her murder did so because they side with the culture of death).

Let's see what you wrote in post #20:

She obese. Look at her. If her sleep apnea was caused by high blood pressure, she had that because of her weight also. What kind of parent makes their child obese and then chooses surgery to fix the problems obesity causes? That's child abuse.

Let me see if I've got this straight, you believe that her condition is partly due to abuse by her family, but you also think her family should decide what's best for her?

Why don't you try explaining how my question was "stupid" in light of your previous statements on the subject.

They can take her home or put her in a home. Their options are limited, but they are there. Their choice to make her obese is just that: their choice. I think it’s abusive but the law doesn’t (thank goodness). They’ve already proven that they don’t make good decisions for her health wise, but whatever they want to do from here on out is up to them.

Listen, I can’t deal with you mentally unraveling and I can’t stand being falsely accused of be pro death anymore. What’s really funny is that @PPact recently blocked me because I made too many antiabortion comments. My comments to them have even been featured on Twitchy.

I still stand by my original comment: She did not have routine surgery. They removed tonsils, adenoids, sinus tissue, and other tissue. That is not routine. Tell the whole truth or tell nothing at all. How this evolved into what it is is beyond me.

You said two years ago the parents had no right to take her because she was dead.

Looking at the figures in the article, it appears that the longest they have kept a corpse somewhat functional after death is about 52 days.

This group, led by T. Yoshioka of Osaka University Medical School, Japan, apparently has done a number of studies in brain dead people.

In any case, I doubt that the heart will continue to beat in this corpse for much longer. Almost certainly, whatever facility they moved her to will not have advanced life-support equipment. The length of time this corpse has been kept ventilated is already beyond the average seen in Yoshioka’s studies (23.1 +/- 19.1 days) (http://www.ncbi.nlm.nih.gov/pubmed/3714004).

The judge who has allowed this travesty to continue long past the girl’s death is reprehensible. I have no words to describe the lawyer Dolan, who must be aware of the facts yet continues to lead the family on.

I think there will be severe legal ramifications in this case. Hospitals do not usually release corpses except for transport to medical examiners or funeral homes.

I think it's abusive but the law doesn't (thank goodness).

Why thank goodness? If someone is being abused it's true regardless of the law, it's nothing to be thankful for.

For starters, nearly ALL tonsillectomies also include removal of the adenoids and uvula. This surgery has been performed an untold number of times over the course of thousands of years. This is about as routine a surgery as there is.

Tell the whole truth or tell nothing at all.

The only lies are the ones coming from those who support murdering Jahi McMath.

How this evolved into what it is is beyond me.

Yet you are sticking to your assertions from the past two years despite the undeniable TRUTH that she is very much alive.

I wouldn’t let this treatment be performed on a rabid dog that bit one of my children—it’s inhumane.
