OAKLAND, California, December 17, 2015 (LifeSiteNews) – 13-year-old Jahi McMath went into cardiac arrest after a routine tonsillectomy in 2013. Jahi was in oxygen-deprived cardiac arrest for two hours, causing brain damage. Though Jahi lived, her doctors said she was "brain-dead," and UCSF Benioff Children's Hospital Oakland and Alameda County officials issued a death certificate.
Since Jahi has been declared "dead," insurance no longer covers her health care.
Jahi's mother, Nailah Winkfield, sued Jahi's doctor, Dr. Frederick Rosen, for failing to tell her that Jahi's surgery would be "complex and risky" due to Jahi's susceptibility to heavy bleeding and for failing to share that risk with nurses taking care of her recovery after surgery.
Jahi began coughing up blood the morning after the surgery; the nurses didn't know she had a risk of serious hemorrhage. The nurses told Nailah Winkfield that Jahi's bleeding was "normal." One nurse even used a suction device to clear the bleeding. Eventually, Jahi's heart stopped, causing brain damage.
Now, Jahi's biological father, Milton McMath, has sued as well.
Jahi caught the attention of the media when her mother refused to take her off life support. The Winkfields removed Jahi from Oakland to New Jersey, where she continues to live and her vitals are strong.
The Winkfields note that Jahi's heart is beating on its own, and her organs are not failing, as would be the case if she were brain-dead. They have released several videos showing Jahi moving and reacting to stimuli.
In October, a judge ruled that Jahi's family could present evidence to determine if she is alive or dead. If dead, the suit would be for wrongful death, with a maximum of $250,000 for damages.
If Jahi is declared legally alive, the lawsuit could be for many millions of dollars.
And still her family has to go to court to have her declared "alive."

Heartbreaking. This poor girl and her family have truly suffered at the hands of these callous ghouls.

I remember the FReepers who were violently opposed to preserving this girl’s life. Who viciously attacked the mother for fighting for her daughter.
Jahi’s organs aren’t dissolving. She’s not rotting. She’s healthy and has started puberty. She responds to stimuli and will wiggle her fingers and move her feet on command. Her higher brain functions are in tact. Medical tests have proven that she hears. She’s in there. The problem is that most of the brain’s commands can’t make it to her body.
This culture of death has even infiltrated the conservative movement.
Most of us in the California BayArea have long expected this type of lawsuit from the family. It’s a tragedy, but that girl has been functionally dead for the last two years.
It’s understandable the family doesn’t want to accept this.
That is their baby, their loved one.
God help this girl and her family and give them peace.

Not unlike some Social Security recipient being declared dead and having to show up at a local office to show they’re still alive and bringing a doctor’s note attesting to the fact that yes, they are indeed alive. Bureaucracy in action.

When a person is truly "brain dead" their heart WILL NOT BEAT ON ITS OWN and their organs begin to liquefy.
Jahi McMath is severely disabled due to the hospital's errors, but she is very much alive.
I hear you. There are almost always some anti-life FReepers who visit these threads. It’s distressing to me and I don’t really understand it.
One of the things that I recall the most about Jahi is her beautiful smile. I hope that her parents are successful.
It wasn’t a routine tonsillectomy! The girl had sleep apnea due to her weight, and instead of being good parents and teaching her better eating and exercise habits they elected surgery. IIRC, they even removed her uvula to make her airway wider and/or less obstructed.
Exactly! NONE of these things can happen if a person's brain isn't functioning.

Sleep apnea is also a cause of high blood pressure. What makes you think that her parents weren’t “good parents”?
She obese. Look at her. If her sleep apnea was caused by high blood pressure, she had that because of her weight also. What kind of parent makes their child obese and then chooses surgery to fix the problems obesity causes? That’s child abuse.
