No. Trump is all talk.
Correct. But if he is referring to federal agents, that is another matter.
No, they are not. There is a Federal 3 strikes law that applies in Federal prosecutions, but does not apply in state prosecutions. Some states (roughly half, I believe) have enacted their own 3 strikes laws, but that is not required by Federal law.
And, there are Federal mandatory minimum sentences for some crimes, but that too only applies in Federal prosecutions, not state prosecutions. Again, many states have enacted their own mandatory minimums for some crimes, but they were not required to do so by Federal law.
Listen to what he actually said. He was going to issue “a strong statement.” Strong statements are made by leaders, but they are not mandates and they are not law and they are not violations of the constitution. Nothing wrong with a president urging the death penalty for convicted murderers.
Trying to nationalize every crime so as to appear "tough on crime" or "supporting our police officers" is a bad idea that leads to more harm than good.
He said that the death penalty was “going to happen” which isn’t a particularly good idea to threaten if you are not in a position to make it happen.
The Donald does not seem to understand our Constitutional republic. The federal government has no say over whether a state applies the death penalty for any particular crime (unless it is an 8th Amendment issue). So as president, Trump could not impose a death penalty for cop killers. Even if they were federal cops or the cops were killed on federal land, the most a Trump administration could do is seek the death penalty - a court has to sentence someone to death after the trial.
This is another case where Trump is saying what people want to hear, without anyone realizing that he has no way to actually follow through...
But he knows how to hire good staff, and any pick he chooses to advise on LE matters, too include the Attny Gen, will be a heck of a lot smarter regarding LE matters than him, and most assuredly, more smart than anybody The Big Zero appointed or Cold Miss will appoint.
Trump is a success because he listened to his advisers.
Yes, agree, his TDS is monumental.
Trump goes full tyrant. Not my type of leader.
Right, but he said that he would issue that “strong statement” as “[o]ne of the first things Iâd do in terms of executive orders.”
Things like this are why I’d a President Trump to have a Vice President Cruz (or another similarly strong Constitutionalist).
Wrong. If what you say is true, the every state would have a 3-strikes law, and all states would have the same minimum sentencing rules. The only thing the Feds can control is federal cases.
Federal death penalty:
1 U.S.C. 848(e) Murder related to a continuing criminal enterprise or related murder of a Federal, State, or local law enforcement officer.

once again this is just people in the media paraphrasing INCORRECTLY what was said and ppl jumping to incorrect conclusions. Kinda like when Trump said he was goign to ban muslims...CUT...leaving out muslims immigrants. Making everyone incorrectly drawing the conclusion that he mean American muslims
I agree with you. That is why is his my first choice, and ahead by a long margin. But his comment was based on his quite proper disgust for the BLM agitprop, and is not within the scope of the authority we both hope he as in a little over a year.
I like Trump, his shocking revelation that maybe we should stop importing terrorists as fast as humanly possible has won me over to his side. But, this just feels like he’s throwing stuff at the wall to see what sticks. In any state that actually has the death penalty, killing a cop puts you at the head of the line anyway.
As to whether he can actually do what he says: Sure, there are federal guidelines, but are we really saying he can make the death penalty a federal guideline? Maybe, I don’t know. We can say he SHOULDN’T be able to but Obama has redefined what a president can and can’t do. One of the arguments for (or against) Trump is that people perceive him as being likely to use all the power Obama has invented for the office of president.
An executive order is not a law.
An executive order is not a law.
Even if the cop is a psychotic serial killer?
Trump once again sets the debate. I hope this gets a lot of airtime.
If a state does not have the death penalty for killing police officers, you should call your state rep and ask why not.
