Neil Stretesky came out the front door shooting when four western Nebraska law enforcement officers pulled up to his house on a dead-end street in Big Springs with arrest warrants.
Deuel County Deputy Michael Hutchinson, who never fired his gun, was shot four times, suffering a serious abdomen wound, according to an account provided by Deuel County Attorney Joel Jay. Moments later, 66-year-old Stretesky â who was out of jail on an attempted first-degree murder charge in Colorado â lay mortally wounded, shot by Sheriff Scott DeCoste.
Streteskyâs record and reputation were widely known and the reason why four lawmen teamed up to serve the warrants Thursday, Jay said. Stretesky was charged with attempted murder after beating his 90-year-old father with a hammer in an incident during which he threatened a Colorado sheriff with a rifle last year.

Why was this guy not in jail for that one?

The LEO who was targeted in that first case should have shot him dead.
Probably didn’t want to participate in a ‘suicide by cop’. Clearly would have been a justified shooting, however.
Yep, he exercised an incredible level of restraint. Far more than the law requires and probably more than he should have. It’s hard to fault a man for not killing another man though.

Paperwork, civil suits, internal affairs; small town, and he may have thought the guy wouldn’t really pull the trigger on him (history has shown that that was probably a false assumption if it is one that he made).
I do wonder if the guy had a history of being a mean snake, or if he was evidencing age related personality changes.
I doubt that he was thinking about all of that at the time he just didn’t want to kill anyone. I’m sure he did make a judgment that the guy wasn’t going to shoot though. We have some pretty good LEOs in CO.

Nope. you appear to want to chop out the 8th Amendment.
It is well within the constitution to not grant bail in certain cases. This would be one of those cases, in my opinion. If you disagree, we shall have to agree to disagree.
“Excessive bail shall not be required”. $1 million is excessive in a domestic dispute with no dead bodies.
Any crime that can legally be met with lethal force should mean no bail at all.
