Alan Grayson Threatens Lawsuit on Citizenship Grounds if Ted Cruz Is the GOP Nominee

While discussing Sen. Ted Cruz (R-TX), Grayson told Colmes he didn’t view Cruz as a natural-born citizen and would challenge his candidacy with a lawsuit if he were selected by GOP voters to be the party’s presidential nominee.

GRAYSON: It's resolved itself into this weird reality show. It's not "The Biggest Loser" that they're choosing, it's "The Biggest Bigot."

COLMES: That's very interesting, are they all bigots?

GRAYSON: Show me one who represents the exception here. In a sense I guess Cruz is not technically that way, because technically he's not even an America.

COLMES: Well, his mother was born here, so I guess like Obama, though it's interesting to me the people who had a problem with Obama, though it's interesting to me that the people who had a problem with Obama's birth certificate don't have a problem with Ted Cruz who literally was born in another country and renounced his Canadian citizenry.

GRAYSON: I don't know … the Constitution says natural-born Americans, so now we're counting Canadians as natural born Americans? How does that work? I'm waiting for the moment that he gets the nomination and then I will file that beautiful lawsuit saying that he's unqualified for the job because he's ineligible.

COLMES: Now I wonder, does he qualify because of having an American mother can considered an American citizen and in fact he renounced his Canadian citizenship to be an American citizen, but you’re talking about American birth, but I believe if that’s one of you parents —

GRAYSON: Look, even the anchor babies are actually born here. He doesn’t even meet that qualification.

By what path do you think it would ever reach the SCOTUS?

there is various ways to petition...I am not going to waste my time with legal Bullspit.

if it was conservatives petitioning it would not make it very far. as it is RACIST to question a Black man and they would be shamed into not following through(which is what happened).

if it was the Cruz case...the marxist would push it to its limits. it might take a number of times and a long litigation period. and depending on the current court it would make the difference between a successful lawsuit or a failure.

Obamacare should NEVER EVER seen the light of day. but we have a Chief Justice with skeletons in his closet who succumbed...he needs to be impeached under the next president

I am of the opinion that the President of the United States should be born on American soil to two American citizens.

Obviously, I am in a minority.

I think it is a very sad commentary on our country and our citizens that we actively support by legal arguments and the meaning of what “is” is, someone who was born in a foreign country (yes, Canada is a foreign country) of only one American citizen, and who was a citizen of said foreign country until a couple of years ago.

Using the argument of Obama is really stretching. I don’t think he was/is eligible by virtue of the fact that his father was not an American no matter where he was born.

I also don’t think Jindal and Rubio are eligible by virtue of the fact that they are anchor babies.

Of course, we could continue this road until we end up with a president who is the son of the Chinese president, born here on vacation.

I am horrified that “conservatives” think this is all okay because it’s their guy. Same logic the Democrats used when it was their guy.

The lack of standing is interesting. Cruz defense have argued that one has to be a member of the electoral college to have standing. That is true, they are the only persons who vote matters in the election.

The Founders did. Same men wrote the laws of citizenship and naturalization in the first ever Congress, which was signed into law by George Washington himself. All this birther nonsense comes from people who think Bill O’Reilly is a serious historian.

Cruz spent his entire life in the USA.
Obama spent his life in muslim nations being a muslim.

Cruz always claimed to be a US citizen.
Obama claimed he was Indonesian and a Kenyan and filed student aid as a foreign student.

Your opinion has no standing in law. What the Founders did in the Constitutional Convention and the laws of citizenship they passed in the first Congress does.

Looks to me that the Democrats are beginning to get worried about Cruz. This is the third hit piece today. Combine that with the fact that the pollsters have abandoned publishing the most recent polling information and replaced that with 5-day moving averages in order to diminish Cruz's numbers.

Cruz is our guy.

Here is what I think but explained better then I can explain

Natural born citizenship: A natural born citizen is one whose citizenship is beyond dispute, not synthetic, not subject to conflicting claims, not granted by statute or by any act of a sovereign, but inheres naturally in the person according to principles that don't depend on laws or decisions of a sovereign.

I don’t for a minute believe the Founders ever intended that someone who is not an American citizen, born on American soil, of American parents be the President of this country.

As I said, since they didn’t envision this and didn’t specifically make provisions for it, everyone is on board for arguing the meaning of “is.”

Unfortunately, the Founding Fathers thought the citizens of this great country would have some pride and common sense.

But I’m sure everyone thinks that all of the hardships and blood shed endured to carve out this country was just so we could return to European thought - like it’s okay for England to be ruled by a German, etc.

It doesn’t matter...all those eligibility cases have taken YEARS to work their way through the lower courts to the appeals courts. How many actually arrived to the Supreme Court? And the result? NO STANDING.

You missed the point...that the law said 0bama was not nbc bc his mother was unable to pass citizenship to her child. Again, the law said that.

In Cruz’s case, the law says his mother can pass citizenship to her child.

The law says it. It’s not just that Cruz is favored - the law says it. It’s not anything else.

While there are similarities in the cases, the difference is that the law did not allow 0bama’s mom to pass citizenship to a child but Cruz’s mom was allowed. It came down to age of mother and years living in the us.

Didn’t you read the short post to you?

It’s what the law said. The age of 0bama’s mom and her years in the US did not allow her to pass citizenship to 0bama.

That’s not the case for Cruz’s mom.

No equivocating. Just the law. Or do you not think the law should be followed?
