DHS Incentivizes Employers to Hire Alien College Grads Over Native Grads Obama administration has proposed new rule to expand program

The Department of Homeland Security (DHS) is expanding a program that awards businesses bonuses when they hire alien college graduates over native-born graduates, according to an analysis by the Center for Immigration Studies.

The optional practical training program (OPT) awards alien college graduates a work permit to stay in the United States for 12 months. If these graduates have majored in science, technology, engineering, or math, also known as STEM fields, the graduates get an additional 17 months of work. This means alien college graduates who graduated in STEM fields would be able to stay in the United States for a total of 29 months.

The new changes DHS is proposing as part of President Obama’s executive action on immigration last November extends the program further to allow these students to stay in the United States for an additional 24 months instead of 17. This extension would allow these students to stay in the United States for a total of 36 months.

“The Obama administration proposal makes the OPT program, for recent alien college grads, even more of a catastrophe than it is already,” said David North of the Center for Immigration Studies. “The current rules give a STEM alien college grad up to 29 months of legal employment, while the proposed program would go to 36 months.”

Because DHS defines a recent college graduate as a student, employees and workers can escape paying payroll taxes. This means that businesses can receive a bonus of $12,000 to hire an alien college graduate over a native-born one.

“This just means that still more resident workers will be denied jobs in favor of the OPT grads, because employers do not have to pay Social Security and Medicare taxes on students,” North said. “This definitional twist will now be worth as much as $12,000 for the employer who chooses the OPT grad rather than somebody else.”

“No one seems to notice that this will rob the elderly by taking money out of the Social Security and Medicare trust funds,” he said.

yesterday i had breakfast in a restaurant and was served by a twenty something. his family had fled the tax ridden state of NJ for the mountains of NC. He graduated from UNC Chapel hill but was waiting tables.

there was just no there there

on his arm was a tattoo of latitude and longitude. he told me it was the spot where he proposed.

That’s not bad enough, but the pay a premium to prefer the ENEMY over the citizen!

REMINDER: Texas took the lead w/ 26 state AG's that effectively put Obama's EO's on hold. They successfully used the argument that factored into the court ruling that Obama had made DACA/DAPA immigrants more desirable employees than Americans.

Graduate with a STEM degree, work 29 months in your field and “voilà!” you’ll find that you have been transported out of the ghetto and in the process lost a significant portion of the perpetually aggrieved mindset.

BACKSTORY The 1980 Georgia General Assembly was concerned about “the increasing sophistication of various criminal elements on the public payroll” (including those in elective and appointive office). The GA Assembly then adopted the Racketeer Influenced and Corrupt Organizations Act (RICO), patterned after a similar federal law.

(RICO is routinely used to try to prove that a legal business was being used for illegal means, and, in at its inception, RICO was used to prosecute drug traffickers or organized crime members).

In recent years prosecutors have applied RICO to crooked government officials: (1) those accused of using their public offices for personal gain, and, (2) tax-paid officials of govt agencies using public monies to flout the law.

To bring a case under Georgia’s RICO law, there must be at least two underlying felonies — such as fraud, bribery, witness tampering (among other felonies).

RICO allows prosecutors to include multiple defendants charged with various crimes in the blanket indictment, and to charge that govt employees, publicy-funded and publicly-sanctioned entities were allegedly part of an ongoing criminal enterprise.

EXAMPLE A govt official commits two felonies by (1) accepting, and, (2) filing falsified documents.

Any public official using tax dollars to flout that law is a lawbreaker: in cases where govt officials on the public payroll not giving public notice is a violation at the federal level of the 1946 Administrative Procedure Act, which requires notice in the Federal Register. Laws demand that taxpayers have the opportunity to submit views in writing.

NOTE If proof is established that RICO'ed criminal public officials impaired the commercial and economic activity of the region, that could also be prosecutable under the Hobbs Act.

Homeland Security Secretary Jeh Johnson announced a $41.2 billion budget request Monday for the 2016 fiscal year.

The budget would improve the unity of effort at the department, Johnson said, focusing on “harmonizing DHS business processes.” Along with the budget, a new Common Appropriations Structure was also submitted to Congress, which would standardize financial planning, programming and budgets for all DH agencies, Johnson said.

There are five areas the department focuses on each year, and the budget is in alignment with those five missions, Johnson said.

<><> The first mission is to prevent terrorism and enhance security in the country by implementing security for the land, air and at sea.

<><> The next mission is to secure and manage the country’s borders, and reduce the number of illegal immigrants and amount of contraband getting into the United States.

<><> The third mission includes enforcing and administering immigration laws and providing safe and secure detention of illegal immigrants in federal custody if they are a flight risk or a public safety concern.

<><> The fourth mission deals with safeguarding and securing cyberspace, which impacts economic security. The 2016 budget would invest in technology and staff to reduce cybercrime and improve the security of federal network defenses.

<><> The fifth mission, Johnson said, is to strengthen national preparedness and resilience so the country can prepare and respond to any type of disaster.

Johnson said before Congress approves any funding for the next fiscal year lawmakers should approve funding for the current year.

“The President’s FY 2016 Budget provides the resources necessary for the Department of Homeland Security to further strengthen our efforts to fulfill our wide-ranging missions, while also being agile and vigilant in the face of ever-evolving threats and recent world events,” Johnson said. “But prior to acting on the FY 2016 Budget, I urge Congress to fully fund DHS for the rest of this fiscal year, as the current continuing resolution is disruptive, creates uncertainty, and impedes efficient resource planning and execution.”

Yep! Everyone knows that we should wait until it IS a law before we comment on what’s in it and how detrimental it is to the United States of America or try to stop its detrimental effects. Forgive us. Pelosi needs to give us a refresher course on what we’re supposed to think. (extreme sarcasm)

It’s a perverse incentive in the tax code, since OPT’s don’t have to pay SS or FICA taxes, and hence the employer is off the hook for their matching part.

90% of these OPT candidates could not withstand an accuracy audit of their resume.
