The Kentucky county clerk at the center of a national firestorm over her refusal to issue same-sex marriage licenses vowed Monday -- just days after her release from jail -- that she would not prevent her office from issuing such licenses but would not personally authorize them either.
Kim Davis, the clerk for Rowan County, detailed what she described as a "remedy" during a brief press conference as she returned to work for the first time since her jailing.
Whether that "remedy" satisfies the courts -- or undermines the legal validity of the licenses -- remains to be seen.
Under Davis' new plan, her deputy clerks will be allowed to issue gay marriage licenses if they choose. She said she would not take action against them.
But the licenses "will not be issued or authorized by me," Davis said. "Any license will not have my name, my title or my authority on it ... instead, it will say it's issued pursuant to a federal court order."
Davis added that she has "great doubts whether a license issued under these conditions is valid."

As predicted. Now all they need is a law or ruling that the licensing authority rests with the office, not the individual holding it, and it is a done deal.
As I warned all along, as long as this was all about her and her rights, instead of about her sworn duties and THE LAW, and the way our constitutional republic is supposed to function, with checks and balances, this whole thing was doomed. I have good friends whom I respect who say, “blame the lawyers,” and I do. But she is a public official, and she is responsible for everything done in her name by her lawyers, and for every public document that proceeds from the office she was elected and sworn to fill.

The licenses issued while she was in jail and last week were all issued without her name on them, and the Attorney General of KY insisted they were valid. I suppose someone will challenge that at some point, as well.

Kim was right to deny them, she simply didn't seem to know that it was against the law.
That's what happens why we put, into office, buffons who take an oath to something they don't read.
I agree with you.
Kim Davis, other than invoking her religious right, should also emphasize the law of Kentucky.
She would be on firm ground had she stood by that and it would be greater fodder for debate about the 10th amendment and states rights and of course, the power given to the judiciary by our constitution.
I haven’t seen where her lawyers thought of that yet.
