Hmmmm.... Is This Why Clinton Aide Bryan Pagliano Is Taking the 5th?

Hillary Clinton aide Bryan Pagliano’s attorney said last week that his client would not cooperate with the FBI and would exercise his Fifth Amendment rights. What does he have to hide?

In fact, he may have already hidden information that will get him into a pile of legal trouble if he admits it.

It was revealed today by the Washington Post that Pagliano was paid to run Hillary’s private server — out of Hillary Clinton’s own pocket. She paid Pagliano an initial sum of $5,000 to set up the server. Pagliano dutifully reported the sum on his financial disclosure form in 2008.

But campaign officials now tell the WaPo that Clinton continued to pay Pagliano to maintain the server until Hillary left the State Department in 2013. The paper could find no record of Pagliano reporting any income from Clinton on his disclosure forms during the intervening years, and the State Department says they had “found no evidence” of Pagliano earning outside income.

Filing a false financial disclosure form is a felony — reason enough for Pagliano to plead the 5th.

Pagliano’s attorney, Mark MacDougall, declined to comment.

MacDougall sent a letter Monday to the House Select Committee on Benghazi, which had subpoenaed Pagliano, informing the panel that his client would invoke his constitutional rights not to answer questions.

There are multiple congressional inquiries into Clinton’s e-mail use, and the FBI is looking into the security of the setup.

A spokeswoman for the Senate Judiciary Committee, which was inquiring about Pagliano’s outside employment, said that Pagliano’s lawyer informed the committee that his client would invoke his Fifth Amendment rights.

Lawmakers interested in hearing Pagliano’s account of the server’s setup and security protocols are considering whether to offer him immunity in exchange for his testimony. If they take the step, Pagliano would be compelled to appear.

State Department officials have declined to explain which agency officials knew about Clinton’s server and whether any had raised questions or concerns about how it was being handled.

“My unsatisfactory but necessary answer to that is, again, that’s not our role in this process to really answer that question publicly; that there are reviews and investigations underway that will look at possibly some of these issues is for other entities to speak to,” State Department spokesman Mark Toner told reporters this week.

Asked by NBC’s Andrea Mitchell on Friday whether anyone in her inner circle ever expressed concern about the setup, Clinton responded, “I was not thinking a lot when I got in.”

“There was so much work to be done,” Clinton continued. “We had so many problems around the world. I didn’t really stop and think — what — what kind of e-mail system will there be?”

E-mails released this week show that members of the State Department IT department’s help desk were unaware of the setup and sought information about why a correspondent was getting a “fatal error” when sending messages to Clinton’s address. The tech support team “didn’t know it was you,” an aide e-mailed Clinton.

Federal regulations allow employees at Pagliano’s level to have outside employment but require that the extra income not exceed 15 percent of their government salary. Employees must also ensure that their outside work not create a conflict of interest with their government job.

Another possible area of criminal exposure for Pagliano is that he wasn’t cleared to have access to classified information. If true, by granting him access, Hillary Clinton may be criminally liable as well.

Pagliano was an IT expert employed by the State Department. One can imagine several areas of overlap that would represent a conflict of interest.

In short, Mr. Pagliano is in deep trouble with the law and if the Clinton machine is looking for a fall guy, he would seem to fit the bill perfectly.

Sigh.

If you are a federal worker, you show up for work, they say, "Here's our email system."
You really don't have to think.

HOWEVER -- If you wish to evade the system, if you want your own email system, if you want secret dealings with foreign powers, if you want to launder millions of dollars -- then "yes" you THEN have to stop and think "what kind of e-mail system will there be?”

This is the political equivalent of the WW1 Aviation tactic called the Lufbery Circle where planes flew in a circle, each protecting the tail of the one before it. The entire Executive Branch is diluting responsibility and confusing a willing media to believe that no one person is guilty, no one action was wrong. Every time something comes to the surface, the finger is pointed elsewhere and officialdom proclaims that an active investigation ties their hands but the investigation is slowed by lack of sequestered money and manpower so no one can make decisions. When it is January 2017, POTUS will issue pardons and new lobbyists, journalist, academics will look for the next turn of the wheel.

In other articles I’ve read that he worked IT for Hillary’s 2008 campaign, then started to work for the State Department when she became SOS. My question is how did he get the State Department job in the first place?

Pleading the Fifth is explained quite simply. He was/is a government employee. He was coerced by another government worker (Hillary) to blatantly and knowingly violate the Federal Records Act of 1950. Forget about Top Secret, Secret, Classified, Foreign Sourced, etc. They were stealing government-related work documents while in the course of government work and storing it improperly in an attempt to avoid FOIA disclosures. Ignorance of the law, even after admitting she “wasn’t thinking”, is no excuse.....except in the Just Us Department who will go out of their way to cover for Hillary the Forgetful.

Any normal thinking person would understand all of that. We are not talking about any normal thinking person when speaking of a Hillary supporter!

When I heard the crowd of her supporters laugh at her attempted joke about snap-chat disappearing all by itself I knew they were a bunch of lunatics!

It is freaking national security we are talking about here! It is not funny!!!!

Interestingly, his attorney seems to have fumbled some papers while with the DOJ, which may have helped get the McDougals off the hook. Oh, and Vernon Jordan is affiliated with the law firm.

Hmm ... what’s the connection?

Surely none of you believe the claim that “Hillary Rodham Clinton and her family personally paid” for Pagliano to work on the server. It’s another dodge.

This was concocted by Hillary’s gang to dodge several bullets. They planted it in the WaPo as if an unnamed campaign source had secretly leaked it, then Hillary used the exact same words to answer a planted question about the WaPo story. She thinks:
1) this will shield her from culpability for using a public employee for her personal work.
2) that fools will believe this minor issue is why Pagliano is taking the fifth.
3) it establishes that the server was really private (whereas it actually belonged to her 2008 campaign and was operated by a government employee.)
4) that it gets Pagliano off the hook for not reporting Hillary’s “private system” as failing to meet DHS security requirements.

Major tell: the planted story and Hillary emphasized that she “and her family” personally paid for the services. Why so deliberately say “and her family”? Because Hillary never paid a dime? Because she considers the Clinton Foundation “her family”? When did these payments happen? Yesterday?

Hillary can prove her claim by producing cancelled checks to Pagliano written and signed by her, drawn on her own account, dated from 2009 through 2013. Oops, she can’t because she’s lying again.

If he had no clearance he was not working on State Department IT or a member of the Foreign Service. I was and have retired, and was IT. His clearance would have been TS-Crypto per state requirements for Information Management Specialists.
