Hillary: Nominee or Indictee?

While perhaps too early for Democratic elites to panic and begin bailing out on Hillary Clinton’s campaign as a doomed vessel, they would be well advised not to miss any of the lifeboat drills.

For Hillary’s campaign is taking on water at a rate that will sink her, if the leakage does not stop, and soon.

Initially, the issue of Hillary and the emails she sent and received as secretary of state seemed too wonkish, too complex, too trivial a matter to sink a candidacy as strong as hers.

Her nomination was considered as assured as any since Vice President Richard Nixon ran unopposed in 1960.

But since it was revealed that as secretary of state she used a private server for her emails, located in her home in Chappaqua, the bleeding of public trust has been unabated.

Her tortured explanation as to why she installed her own server only raised suspicions. Her erasure of 30,000 “personal emails,” her initial refusal to turn her server over to State, her denials she ever received confidential information, her wiping of the server clean, her stonewalling, have all ravaged her reputation for truthfulness. And truthfulness was never Bill or Hillary’s long suit.

And the issue of Clintonian entitlement and privilege has arisen again.

For Hillary showed a casualness in handling the nation’s secrets that would have cost a civil servant at State, Defense or CIA his or her security clearance and job. And they would be facing charges and potentially jail time.

Indeed, now that Justice and the FBI have been called in to look at Hillary’s handling of state secrets, it is not impossible that at the end of this road lies a federal indictment.

Should that happen, her campaign and career would be over. And should that indictment come later rather than sooner, the Democratic Party could be headed into the election of 2016 led by a Brooklyn-born septuagenarian Socialist.

Every day that new revelations come about Hillary and her emails, and every week that passes between now and when the filing deadlines for the primaries begin to fall, this becomes a real possibility.

Again, the problem here for Hillary and the Democratic Party is that the investigators at Justice, the FBI, and in a hostile Congress and the media, are far from wrapping this up.

They all have their teeth in it, and they are not going away. And there is nothing Hillary can do to halt the investigations, or plug the leaks, or, it seems, to change the subject.

What, really, is the relevance of her $350 billion plan to get the super-rich to pay off student loans, if Hillary is being lawyered up?

The Democratic Party is approaching the fail-safe point.

If it appears that Hillary is headed for the knacker’s yard, then to whom do the Democratic elites turn, and, equally important, when do they move?

For they cannot wait too long.

Hence, a “Draft Biden” movement has begun, and veterans of President Obama’s campaigns are signing on.

Yet the vice president should think long and hard about whether and when he plunges into the Democratic race. For his announcement of availability would be a signal that Joe Biden thinks Hillary is politically dead, or close to it, and he is coming in to drop the hammer.

This would be seen as act of crass political opportunism, seizing upon Hillary’s travails, shouldering her aside, and seizing a nomination millions of Democrats have long believed was hers by right.

How would the millions of Democratic women who have looked forward to the first woman president respond to Biden’s barreling in and finishing her off? How enthusiastic would those women and feminists be for a Candidate Biden who had delivered the deathblow to Hillary and blocked for another decade any chance of a woman as president?

Joe would certainly be up for Chauvinist of the Year 2015.

And other problems would arise for a Biden candidacy.

Would Bill and Hillary Clinton be out there stumping to help Joe win the presidency, when both had dreamed of her having it?

Joe would have to beat Bernie Sanders and rout the Elizabeth Warren liberals. He would have to woo back the big contributors in the Jewish community who believe Barack Obama and John Kerry threw Israel and Bibi under the bus to cut a deal that empowers the world’s leading “state sponsor of terrorism.”

If Joe is having second thoughts about getting in, who can blame him?

As the old saw goes, “Don’t put all your eggs in one basket.”

But for Democrats, such counsel comes too late. Hillary is carrying their basket of eggs, and slipping all over the sidewalk.

If they procrastinate in designating someone else to catch the basket if it falls, they get Bernie. But if they move too soon, they will be charged with sabotaging the last best chance for America to elect a woman president.

A nice problem for those ubiquitous cable TV talking heads who identify themselves as “Democratic strategists.”

Attention Trey Gowdy and other investigators:
1) Who transported Hillary’s server from NY to NJ? Did the Secret Service (who Hilary insists had been guarding it since it was really Bill’s Lie-Berry/Foundation asset) accompany and supervise the transport of the server? Per the interview with Platte River Networks, did they just take it, lock it up, not power it up, connect it to the internet, or not have it functioning as an active email server? Was there continuity of server activity between May 2013 to August 2015, or did the server go off-line starting in June 2013?

2) Who received actual server in NJ - the name of the Platte River Networks employee/technician? What WAS it - make/model/form factor, etc.? Did the Clinton Foundation (or issuer of th RFP on Hillary’s behalf) indicate that the company that would provide data services qualified to handle national-security-level data?

3) In various interviews and reports, Platte River Networks repeatedly stated they were to “upgrade, manage, and secure” the server. What - specifically - does that mean?

4) What did Hillary’s RFP/contract order the data center to do specifically?

5) Does Platte River Networks have sufficient security clearance to handle this type of contract?

6) What were the firewall protocols in place at the time?

7) Who - by name - had access to the server, and the administrative authorization to wipe and cleanse the server? When was that done? Does “upgrade, manage, and secure” the server mean that they PRN was given the task to remove all data from the server when it received it in June 2013? 8) Was malware or antivirus also on the server? Was the inherent firewall, virus protection, or operating system “upgraded, managed, and secured”? Any incidents reported such as DOS attack, hacking, etc.? What were they? How were they resolved?

9) Other than arranging for the server to be moved from NY to NJ, what was the Denver company contracted to do in relation to maintaining the server? What tanglie evidence is there that the server arrived in functioning condition, was being used as an email server, was “upgraded, managed, and secured”, then wiped just prior to seizure by the FBI?

10) Were normal and regular backup procedures executed on the server, and where would the back ups be kept? If no backups were taken, was there a disaster recovery location? Where was that? If no backups and no disaster recovery, what was the plan if the equipment failed or found to have been wiped of any functionality?

11) Were any foreign nationals employed at Platte River Networks that had access to the Clinton server?

I’m perplexed. She’s not a very good campaigner, either from a standpoint of strategy or personal appeal. I guess because she’s female and has a D beside her name makes the big difference. With an R, she’d already be in jail.

If she were an R and her name was "Petraeus", she'd be on probation.

It's been suggested that the Petraeus prosecution (or persecution) was just done to set things up for this. In comparison, Petraeus was prosecuted for driving 26MPH in a 25 MPH zone. Hillary was driving 180 MPH in a school zone without a license in a stolen car carrying bombs and machine guns.

(My guess is that Obama's own Rasputin, Valerie Jarrett, is behind this. It's waaaaaay too complicated for Obama.)

My other guess is that the planned sequence of events would be grand jury/indictments, followed by withdrawal from the race, followed by a presidential pardon.

The buck-raking Clintons desperately want us to believe that State Dept computers were wiped clean, emails deleted, server was safely stored in Denver, etc.

I firmly believe they hung on to the servers b/c they contain important financial details of the Clintons holdings....such as where they stashed the $6 billion missing from the State Dept....and zillions accrued from selling state secrets.

Top level SCI intelligence under Secy Hillary's control relates to US ntl security. It is very very valuable to foreign govts. The intel is subject to tightly controlled protocol: stored in highly secure “read rooms” known as SCIFs. Before entering, cleared officials are required to place cellphones, BlackBerrys, iPads, laptops and other electronic devices on a shelf outside the monitored facilities. TS/SCI material is transported between SCIFs in locked bags carried by special couriers. Clinton aides, however, put it into electronic form.

As far back as 7/26/13, US Sen Charles Grassley (R-Iowa) has been pressing the State Department to answer questions over top Hillary aide, Huma Abedin’s, lucrative govt job arrangement.

Sen Grassley wrote in a June 13 letter:

“It appears that Teneo Strategies may have been compensating Ms. Abedin for gathering information from government sources for the purpose of informing investment decisions of her consulting clients - or in other words, political intelligence. "

" This raises important questions about whether Abedin’s dual role was adequately disclosed to government officials who may have provided her information without realizing that she was being paid by private investors to gather information.”

Charles E.Grassley’s (R-Iowa) inquiry WRT possible “criminal” conduct by Hilary aide, Huma Abedin, got a response from State Dept investigators who concluded Abedin was overpaid by nearly $33,000 because she claimed leave time pay even though she was actually on leave.....a violation of US govt rules governing vacation and sick leave.

Sen Grassley needs to determine:

<><> (1) whether Abedin is still on the State Dept payroll collecting govt checks (an old bureaucratic trick), and,

<><> (2) whether Abedin violated 18 U.S.C.§1027; Abedin might have made false statements and colluded to conceal activities in relation to documents required by the Employee Retirement Income Security Act of 1974.

It is also possible that Abedin’s collusion w/ Hillary, and other hidden offenses could include civil and/or criminal RICO violations. Hillary allowing Abedin’s several employments could also involve BUT not be limited to:

<><> Title 18 U.S.C. §1341, Mail Fraud, 18 U.S.C.§1001, Presenting a False Document to an Agent of the US Government (involves several felonies and could include forgery);

Possibly infractions centering on RICO conspiracies under 18 U.S.C. §1962(c); investigations could be warranted because (1) the persons (2) were employed by or associated with an enterprise (3) that engaged in or affected interstate and international commerce and that (4) the persons operated or managed the enterprise (5) through a “pattern” (6) of racketeering activity, and (7) the taxpayers were injured by reason of the “pattern” of racketeering activity.

Alleged Offenses could include Violation of Title 18 U.S.C. §241 – Conspiracy Against Constitutional Rights – which prohibits in relevant part, “two or more persons (from conspiring) to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same . . .” See, 18 U.S.C. §241.
