A Maryland man has been charged with handcuffing and fatally beating his girlfriend's 9-year-old son over a missing piece of birthday cake, according to court records.
The suspect, Robert Wilson, 30, of Hagerstown, was charged with second-degree murder by a Washington County grand jury on Wednesday.
Prosecutors allege that Wilson handcuffed and beat Jack Garcia on June 30 when he took a piece of birthday cake without permission at the home in Hagerstown, about 50 miles northwest of Washington. Jack died on July 5 at a Washington hospital.
Jack's mother, Oriana Garcia, 26, and his uncle, Jacob Barajas, 23, had earlier been charged with second-degree murder and child abuse. The grand jury added charges of assault and child neglect, Washington County Circuit Court records show.
Police say Garcia did not allow emergency responders to provide medical treatment to her son after knowing he was beaten.
Before the grand jury indictment, Wilson had been charged with child abuse, assault, endangerment and neglect.
Lawyers for Wilson, Garcia and Barajas did not respond to requests for comment.

She’s 26, with a 9 year old son. Which means he was born when she was 17. Sounds like the father is long gone. Its very sad how so many people live their lives.
The chances of something like this happening increase astronomically when the mother is living with a man not the child’s father.
I printed the boys picture yesterday and put it in my cubical, a sweetheart of a kid, my kids are at their grandparents and I did not have a chance to hug them last night.

Well, I speculate it’s probably down to two things:
#1 - Women who have children that young and without marrying first probably don’t have the best judgement to begin with, and that extends to judgement in men. They also tend to be risk taking types that are attracted to risky, exciting (and dangerous) men.
#2 - Mothers with young children are not hot commodities on the dating scene, because most men would rather not clean up someone else’s mess. Sometimes, they have to take what they can get.
This is what happens when one has NO life in Christ, and it will happen again and again.
Jesus brings joy, even [and especially] in tough situations.
The devil, however, only brings pain, lack of patience, and everything else that is ugly.
This behavior is commonly seen in baboons, where an alpha male looking to mate with a female baboon chases her mate away and then proceeds to kill the offspring of his predecessor.
People who abuse a child should be sterilized so they cannot ever bear or parent a child again.

Big, brave man. You are gonna be so popular in the clink. Child abusers always are. The good part is you probably will only serve @ 6 months on a your life sentence.
