They should have re-used the argument for not ruling on Alabama's sex toy ban in 2005:
"If the people of Alabama in time decide that prohibition on sex toys is misguided, or ineffective, or just plain silly, they can repeal the law and be finished with the matter," the court said.
"On the other hand, if we today craft a new fundamental right by which to invalidate the law, we would be bound to give that right full force and effect in all future cases including, for example, those involving adult incest, prostitution, obscenity, and the like."

Is there a reason not to immediately push for a constitutional amendment defining marriage as one man and one woman? The best reason I can think of is that it is a waste of time. If the hearts of people are not changed, we are going down and going down hard. We need to find ways to survive the fall and come through on the other side.

Scalia is a patriot.
His dissent here, and in the 0bamacare case yesterday, state in the clearest most unequivocal terms that our fundamental liberties have been placed in real and active peril.
If there were a serious, principled insurrection against the tyranny of Washington and for the restitution of our liberties, as of today I would join it.
Gladly and willingly.

He'd make more of a splash by calling the institution he is in, illegitimate, and encouraging people to violeate the ruling handed down by the majority. Instead he reinforces the legitimacy by assertin g that people are "ruled" by this utter nonsense.

No way it would get 2/3 of the States to pass it, Marxists liberals have won the battle of the minds and hearts of the youth. The Boomers turned out to be not very good at parenting or fighting the enemy within. Of course that is a generalization.

I’d go one step further and have Thomas and Alito resign with Scalia at the same time. Their appointed replacements would not be accepted by the public, even if they are appointed by Congress.
Walking off of the court mid-game due to poor refereeing and cheating by the other team. Historically it would be viewed as resigning with honor and would perhaps start some sort of legal civil war.
Perhaps it will only happen in one of those alternate history books....
