Scalia leads scathing dissent on ObamaCare ruling, dubs law 'SCOTUScare'

“We should just start calling this law SCOTUScare,” Scalia wrote, referring to the several times the high court has ruled on controversial parts of ObamaCare.

Scalia blasted that reading.

“The court holds that when the Patient Protection and Affordable Care Act says ‘Exchange established by the State’ it means ‘Exchange established by the State or the Federal Government,’ Scalia wrote. “That is of course quite absurd, and the court’s 21 pages of explanation make it no less so.”

I remember well the howling Bush got for nominating Harriet Miers. Thanks to all the republican uproar (Laura Ingraham being one screaming the loudest), Miers withdrew and we got Roberts Alito. Thanks...thanks a lot.
W initially nominated Roberts to replace O’Connor when she retired. When Renquist died, Bush withdrew Roberts’ nomination for Associate Justice and resubmitted it for Chief Justice. He simultaneously nominated Miers for Associate Justice. Who knows but that the vote would have been 7-2 had Miers been there instead of Alito . . .

I really expected any ruling upholding this monstrosity to have tons of legalize and contortions that defy the laws of physics. Instead, 6 of what are supposed to be great legal minds fall back to the "awww, you know what they meant" strategy.

Ten years ago, if I had written this admin's events to date as a movie script I would have been mocked and ridiculed.

The Suipreme Court was supposed to be ‘we the people’s’ last line of defense against a rogue president- meaning that the supreme court was supposed to be the leash which keeps a president in line- preventing him/her from declaring any law they like- the supreme court is supposed to rule based on laws already on the books, and brought to them by congress- a president is NEVER supposed to have the ability to create unlawful laws that violate laws already o nthe3 books-

We no longer have our last line of defense because this supreme court makes law as it goes and is making law which supports the unconstitutional law that the lawless _resident is creating

The supreme court was always meant to be our last refuge- our last lien of defense against rogue president or rogue congress- Now we have NO line of defense- none- the SC is complicit in denying us our constitutional inalienable rights-

I disagree- it’s very disheartening- knowing how spot on, how right he is AND knowing he is now in the minority and will never have his voice heard for beign overridden by the TRAITOR john Roberts- It’s sad watching truth and justice hammered by evil

You can bet the farm that the powers that be have already pre-determined 2016 will be about another Bush and another Clinton duking it out for the White House.

Me? I'll be staying home. I refuse to vote for the lesser of two evils anymore --- especially when you can't tell the difference between the two!

Roberts’ opinion is that law(s), esp. this Obamacare, were passed by representatives elected from the people, and his job is to uphold such law(s). If you don’t like the law(s), elect some one else to represent the law-writing.

Isn’t that enough ground to remove him from SC?

What amazed me was that Kennedy - who was infuriated with Roberts for switching at the last moment at the first Obamacare vote - now sides with him.

It’s all about the money.

If Obamacare is not reversed it will result in CW2. Unfortunately CW2 may be inevitable anyway. It will be certain if the SC forces states to accept homosexual marriage.

Civil war needs two sides fighting. That will never happen.

Not to mention going from a balanced budget to a free for all with Hastert and Frist doleing out earmarks while George W. kept his veto pen in his pocket. Bush’s compassionate conservatism was nothing but a lie.

Of course his father was the same. Appointing Souter to the Supreme Court, walking away from his “No new taxes” pledge, driving the conservative Reagan people out of his administration, and running a feckless campaign against Bill Clinton. Don’t forget Colin Powell had key roles in the administrations of both father and son Bush.

No, Roberts was appointed first. We got Samuel Alito instead of Harriet Miers. And Alito has been the third most solid justice since (after Scalia and Thomas).
