'Accused is guilty': Campus rape tribunals punish without proof, critics say

A former Amherst College student is just the latest in a long line of men whose lives have been turned upside-down after being accused of sexual assault in what they say were consensual encounters, punished in campus tribunals where, in some cases, critics say, they’re guilty even after proving their innocence.

The former student, whose name has not been made public, was expelled after his alleged victim, the roommate of his girlfriend, complained some 21 months after the incident and despite what evidence appears to show was consensual sex. As in many campus procedures which enforce school sanctions and not criminal law, only a finding that he was “more likely than not” guilty was necessary.

“Essentially the procedure there works under the assumption that the accused is guilty and needs to use the hearing to prove his innocence,” K.C. Johnson, author of “Until Proven Innocent: Political Correctness and the Shameful Injustice of the Duke Lacrosse Rape Case," told Fox News Channel's Megyn Kelly. “But he isn’t given the tools to do that. He doesn’t have discovery, he can’t get the relevant evidence he needs, he doesn’t have an attorney representing him [and has] limited right of cross examination.

"So there’s virtually no way, once an accusation is made and gets into the system at a place like Amherst, and Amherst is not unique, that the accused can be exonerated,” Johnson said.

Yes, dunk them. For 15 minutes. If they live, they are innocent. If they drown, they are rapists.

(And don’t worry about liberals not being able to square this with their scream of “Abomination!” against water-boarding terrorists. Liberals have absolutely no problem holding two absolutely contradictory ideas in their little brains at the same time.)

I am offering my services to any needy college students, to act as their “sex witness”. I will sit quietly in a dark corner of the room to make sure that consent is asked and agreed to for each individual act of a sexual nature, and, if necessary, I will provide my unbiased, eyewitness testimony to any college tribunals as needed.

Now, I know $100/hour sounds like a steep price for this service, but remember, your reputation, and future livelihood is at stake!

On the bright side, the lack of due process for men accused of rape on American college campuses may have a chilling effect on the hook up culture there with the attendant benefits of fewer STD’s and abortions and more focus on long-term, committed relationships.

Men need to forgo having any contact with females in college.

Seems harsh, but you simply cannot trust any of them no matter how pretty or level-headed they come across. One bad date or forgotten birthday and that freak will have your a** in front of one of these.

And even if it is proven that nothing happened, she still wins as you are branded for life and maybe expelled.

IF there is ANY justice, the young man’s lawsuit against AMHERST should bring him enough money to purcahse a country of his very own.
If this comes to past, he can base it on the once revered Constitution of the United States of America.
It is something to wish for.
Also, the results for Amherst could even get through to the rest of Academia in this country.

How to stop these heretical tribunals?

If the person has or is suspected of committing a crime, it is the prevue of the city/township/state/feds. No school tribunal has jurisdictional authority and any student faced with such a situation should take appropriate action to secure his/her Rights under the LAW.

While we may think of college students as “kids” legally they are not kids. They are adults privileged to all the protections of the LAW. They do have Rights and all it will take is one savvy attorney willing to bring the full force of the law down on the heads of these ‘rape campuses’.

It is time to challenge these liberalized bastions as not being exempt from the law. If rape(s) are so rampant on campus...perhaps it is time to call in the FBI. Last time I checked, most allegations of rape fall under the federal or state authorities...not a rinky-dink school tribunal.

You'd think the death-knell STDs that first popped up in the 80s and 90s would have had that effect. If people are still willing to risk losing their autoimmune system, I think they'll be equally undeterred by the risk of losing a court case.

This is aided, abetted and encouraged by our own Federal Government through the Department of (mis)Education and its exclusive control of taxpayer money (student loans, Pell Grants etc.) College Administrators (a craven lot at best) bend over and say, “Please, can I have another!” when a DoEd farts in their general direction. This Administration has gone full bore in a war on males in Academia and this is part and parcel of that fight.
