Pot may be legal in Colorado, but you can still be fired for using it.
The state Supreme Court ruled 6-0 Monday that a medical marijuana patient who was fired after failing a drug test cannot get his job back. The case was being watched closely by employers and pot smokers in states that have legalized medical or recreational marijuana.
Colorado became at least the fourth state in which courts have ruled against medical marijuana patients fired for pot use. Supreme courts in California, Montana and Washington state have made similar rulings, and federal courts in Colorado and Michigan also have rejected such claims.
The Colorado worker, Brandon Coats, is a quadriplegic who was fired by Dish Network after failing a 2010 drug test. The company agreed that Coats wasnt high on the job but said it has a zero-tolerance drug policy.

It would also be okay for drinkers to down a few adult beverages before work and not get fired because they were not drinking on the job.
Join the UAW and they take care of that little problem for you. I've had more than one Chrysler worker in my area tell me that. One was caught with beer in his toolbox fridge. Since it was unlocked during his shift, they made the case that anybody could have put it there.
One frequents the local pub and drinks 2-3 beers, and takes a 6-pack for the ride every. single. afternoon on his way to work.

My husbands brother worked for GM. He was an alcoholic the whole time he worked there.
Then it's safe for me to fire that old boy I caught using my brake spring removal tool to to pull the butthole of of a nearly dead raccoon. He said he was checkin' the poor things core temperature.
It really is a catch-22, he is NOT a drug abuser, but taking the stuff to alleviate a medical condition. The company SHOULD change its employment terms!
The guy should move to CA. I terminated an employee in the early 90’s for failing a drug test ( heroine). I lost the unemployment case because I could not prove to the Judge heroine could impair your ability to operate heavy equipment. I told the Judge I did not want any employees operating equipment with heroine in their system. The Judge said since I was not a medical Dr and could not produce studies of the amount of heroine, in your system, that could cause impairment, the employee was entitled to unemployment benefits and his job back.

Coats was paralyzed in a car crash as a teenager and has been a medical marijuana patient since 2009, when he discovered that pot helped calm violent muscle spasms.
I question that as someone who was paralyzed. I take baclofen for muscle spasms and it worked. Took robaxin and that worked too. Imo, this guy wants to smoke pot to get high.
1. According to libertarian theories corporations can require workers to abide by any reasonable conditions in order to get and maintain a job at that company, e.g. Thou shalt not smoke or else pink slip.
2. According to libertarian theories people should be able to imbibe whatever substances they want so long as they don't do harm to others, especially natural substances such as marijuana which when properly used pose no significant harm, e.g. Toke away.
So what happens when a midnight toker wants to work at a decent company that claims to be a rugged, entrepreneurial, capitalist company but in fact is a bunch of cowards fixated on "risk management" that require the workforce to maintain 50's era lifestyles so that some set of suspect measures are maximized?
Well the strict libertarian tells the pot head to start his own company or search the classifieds and ask each hiring manager he manages to get an interview with if they have a drug policy, thereby guaranteeing that every hiring manager will choose not to hire him.
So now every pot head must start his own company or find a company that goes out of its way to hire the potheads that no one else wants. Which doesn't seem like a recipe for success.
It's another case of the libertarian snake eating its own head.
