Judge Napolitano: Prosecute ‘Hothead’ McKinney Pool Party Cop

The resignation on Tuesday of McKinney, Texas policeman Eric Casebolt after the widespread viewing of a video showing Casebolt drawing his gun and brutalizing a teenager outside a pool party may not be enough to bring justice, suggests Judge Andrew Napolitano. Napolitano, in a Fox Business interview, argues that it would be proper to prosecute Casebolt.

Reviewing the video footage, Napolitano explains to host Stuart Varney that Casebolt, who Napolitano calls a “hothead,” appears to have committed an illegal assault:

Varney: The police officer could be guilty of a crime?

Napolitano: Oh sure, it’s an assault for him to pull the gun on someone when it’s contraindicated under police procedures. He can only pull his gun to resist deadly force. There is no deadly force being applied to him.  Napolitano, a Ron Paul Institute Advisory Board member, explains later in the interview that further action should be taken against Casebolt stating:

[T]he tape that we saw showed unlawful behavior on the part of that cop. His superiors were right to suspend him and investigate. The prosecutor would be right to prosecute.

I don’t have a dog in this fight on the McKinney thing but for Napolitano to say it is illegal for him to pull a gun when it is “contraindicated to police procedures....” is oblivious to recent events around this country.

The LEO is not a mushroom who wasn’t aware he was in the midst of a group of blacks who were verbally combative. We’ve seen and read where there were very recent multiple instances of LEs getting shot. Frankly, he likely thought his life was in danger or at least a high probability it could escalate to that. Pulling his weapon would be the only action that could deter further escalation. So. Napolitano says he should be prosecuted for fearing for his life, I guess.

comments like this saddens me. I think the officer did something wrong and unfortunate and fortunately there was not a bad outcome. I think that the police officer realizes this and was right to resign but going after him criminally is just plane wrong. being a cop is a hard job and one that I no I could not do. the cop was in bad situation did not handle him self in the best way but if we start to criminally charge cops every time they make a mistake the good and smart one will not become police officers because anyone with A brain knows that one day they will make a mistake .

I went to vegas for a bachelor party with 12 cops. they were insane. but the things they told me they saw regularly would drive one crazy.
and many forget these aren’t 40 or 50 year olds.
these are kids in their 20s mostly.
I was a crazy mess in my 20s.
I don’t know how there are so few gun incidents considering what they’re up against.

I must have seen a different video. I heard an officer command the girl to lie prone and watched her resist. Just one more snot nosed spoiled teen with thugs threatening the officer.

That man that ran up behind the cop for some purpose, slipped on the grass and got closer than he may have intended. But, clearly the cop thought the man was after the cop's gun.

I think Napolitano has lost his mind.

What cop in the country would put himself out to help a citizen after this debacle?

The guy that slipped on the grass said he was accidentally pushed twice by the guy next to him and it does look that way but you are right about what the officer thought. To prosecute the officer is rediculous.

the problem is that he drew his gun. you are right about the kid. the mom and dad would serve her better by punishing her for her behavior not indulging her fantasy of being a civil rights protester that was beaten up by the police.

That very same Ron Paul Institute has ties to shady Pro-Soviet/Russian propaganda groups as well as Russian ideologists like Alexandr Dugin, a man likely under the direct control of the FSB.

I have a suspicion that the Ron Paul loony wing is being used as a vehicle for propaganda of all sorts, including anti-local law enforcement stuff, and guys like Napolitano are useful idiots for that cause.

Notice that Rand Paul has also echoed some of this stuff himself in his pandering.
