... In a statement on Wednesday, officials from the Justice Department said they would not ask the Supreme Court to reverse this week’s decision by the United States Court of Appeals for the Fifth Circuit that continues to block the president’s immigration actions.
“The department believes the best way to achieve this goal is to focus on the ongoing appeal on the merits of the preliminary injunction itself,” said Patrick Rodenbush, a spokesman for the Justice Department. “Although the department continues to disagree with the Fifth Circuit’s refusal to stay the district court’s preliminary injunction, the department has determined that it will not seek a stay from the Supreme Court.”
Rather than continue to fight to overturn the judge’s blocking order, administration officials said Wednesday that government lawyers would wait and make what they believe will be a stronger argument on the merits of the president’s immigration program.
The decision not to ask the Supreme Court to allow the program to move forward now is also the result of a practical reality, officials said. Even if the court had given the government the green light to implement carry out program, the ongoing legal fight would probably have scared away most of the undocumented immigrants who would have to come out from the shadows to apply for the benefits.

That's my take on it too. Obama's got a track record of not complying with court orders, and no one in authority has challenged him on it.

Yes, they know they will lose in front of the SCOTUS.
But, they now have secret free-trade powers that may allow them to open the doors to immigrants. The plan may be to flood the system via that channel.
So this means we can count on the DOJ taking it to the Supreme Court..
It doesn’t matter what court this goes to or what any court says about it. Obama will quietly continue with his amnesty program. He’s already been doing it.
Progressives detest the law. They couldn’t care less what some court orders. Violating the law comes easily and naturally to them.

All fine and dandy to ignore the court until the court sends out US Marshals to arrest a few Obama bureaucrats for contempt to cool their heels in jail.
President James Madison, Madison generally regarded as the father of the Constitution, had vetoed the public works bill of 1817 which was passed by Congress, explaining in the constitutionally required veto letter that the states have never delegated to the feds, expressly via the Constitution, the specific power to build roads & canals.

Note that the only exception to making intrastate roads was making mail roads as evidenced by the Constitution’s Clause 7 of Section 8 of Article I.
Getting back to lawless Obama, he probably knows that he is wrongly using presidential authority not only to sign unconstitutional bills into law, but also to carry them out.
And speaking of unconstitutional bills, note that as a consequence of the ill-conceived 17th Amendment that the corrupt Senate is not doing its job to make sure that unconstitutional bills never make it to the president’s desk in the first place.
The 17th Amendment needs to disappear, and a bunch of corrupt senators along with it.
