The cabbie was in his rights to tell the women to stop making out in the car, but should have stopped short of the insults.

Who said he insulted them? Even if he did, would he have been fined $10,000 if these were two straight woman he had insulted? The insults were derogatory toward women in general, regardless of whether they were straight or lesbian.
