So, the process begins. I always find it interesting to ask the same Judge if he/she has changed their mind. I once heard a federal judge explain to an opposing litigant that Federal Judges don't get do-overs. They don't often change their minds. After Hanen rules, it will be on to the 5th Circuit. I suppose they might ask Hanen about it as it is a free bite at the apple.

Justice Department lawyers requested a “stay” to delay a federal judge’s decision to block USURPER Obama’s UNCONSTITUTIONAL immigration order, which ILLEGALLY allows 5 million ILLEGAL ALIENS to stay in the country ILLEGALLY.

Fixed it.

If I were a Judge reviewing the Admin. request I would have to delay the hearing for atleast 2 weeks for me to stop laughing at their fearmongering...

Bambi has been in office for what 6 years. He and the DHS have the right to decide weather to deport individuals. A right they have used liberally for those 6 years.

Now they are claiming there is an Emergency because a Judge haulted them from Legislating New Rights for Criminal Invaders?

Astonishing...

He won’t get it. IIRC, a panel of 3 of the 5th circuit could get first shot at it after that, and depending on the makeup of the panel, they could rule for or against the president. An en banc ruling would be the entire 5th circuit that is more conservative, so they would overrule their own panel if it decided something they thought was wrong. It would then go to the Scotus. We could be talking a year+ from now which would put it directly in the middle of the presidential campaign.

So this is from action conducted by Congress and signed by the president? No? Then it wouldn't be legally.

The Justice Department is asking Hanen to put his ruling on hold while the federal government appeals the decision. If the stay were to be granted, Obama’s immigration action would be allowed to go forward while the lawsuit proceeds through the courts.

This is a very hot issue if they grant a stay....then that pretty much will give Obala carte Blanche to move forward and those earmarked for deportation will be here indefinitely...and more.

The administration's request is silly and arrogant. The judge's ruling the administration is trying to overturn is a temporary injunction to maintain the status quo until there can be a fuller hearing on the merits of the matter.

So the administration is saying that it is urgent to change the status quo -- never mind a fuller hearing on the merits.

If -- big if -- there is any integrity in the appeals court, this is going nowhere.

The 5th Circuit in New Orleans might better be described as "Constitutionalist" rather than "conservative," a point that I'm sure would be lost on someone working for the "Immigrant Legal Resource Center" who is no doubt totally unfamiliar with the traditions of this country.

Here’s the way it’s going to go.

- Hanan denies Holder/Obama on Wednesday.

- Goes to 5th Circuit panel of 3. Obama/Holder hopes for 2 dingbat libs judges on panel to vote against Hanan.

If Obama gets lucky where their stay is granted, then Texas plus 25 states ask for an En Banc hearing that reinstates Hanan’s block.

If Holder/Obama loses in the 3 judge panel, they likely skip the en banc going straight to SCOTUS since the 5th Cicuit in New Orleans is seen as conservative, and the OBot losers don’t want to waste more time.

- Scalia overseas 5th Circuit so denies stay.

- Obama/Holder are now free to seek out liberal sitting on the Supreme Court. They pick Ginsberg or another bad liberal.

- Ginsberg grants stay. Before this hopefully much time is wasted running out the clock on the Obama Administration.

- Case likely gets kicked back to the 5th Circuit of Appeals where the merits of the case are argued.

This is not about "halting deportations". Obama was never going to deport them regardless.

This is about giving them legal status. It is about issuing work authorization cards, tax payer IDs, U.S. travel documents and travel permission (advance parole). -- all completely without any basis in law.

This is about a coup.
