Obama Administration Unlikely to Seek Emergency Stay on Immigration Ruling

While President Obama has made it clear his administration will appeal District Court Judge Andrew Hanen’s ruling blocking his executive action on immigration, the president’s immigration plan will likely be on hold for months or longer.

Though no final decision has been made, Obama administration sources told ABC News today that the Department of Justice is unlikely to seek an emergency stay to block the judge’s order. The reason is simple: While DOJ thinks it will ultimately prevail on the overall appeal, department officials believe they would not succeed in seeking an emergency stay of Judge Hanen’s ruling.

The judge’s ruling is likely to remain in place while the case is appealed before the 5th Circuit Court of Appeals and, quite possibly, to the Supreme Court. That process is likely to take six months -- or longer. That means the 5 million undocumented immigrants who had been hoping to apply for DACA (Deferred Action for Childhood Arrivals) to obtain work permits, drivers licenses, and relief from fear of deportation will have to wait.

This case will stay in the 5th Circuit. That is why they will wait until they can appeal another case in another circuit. Most likely they will get a friendly plaintiff to file a fake case in another circuit that they can take up on appeal.

I’m pretty confident that this has been stopped in it’s tracks for now. Obama properly assumed his ‘directive’ would spark Republicans into giving him exactly what he wanted, and was likely surprised when the herd didn’t come rushing in to give everything to the illegals once again.

Welcome to lame duckhood, Mr. Obama, where we count down the days until you’re out of office and you can set up a presidential cubby hole to hold your trophy for worst president ever.

Bet they’re planning his world wide goodbye tour even as I type, so Obama can spend three months vacationing at our expense (and enjoying the best golf of his life.)

This will be in court for years, and when Obama leaves office this “order” no longer exists.

The amnesty establishment wants political cover on this, ideally a pro-amnesty Republican being nominated for President or an anti-amnesty one losing the election.

A bigger threat to Homeland Security is not not funding it, but open boarders and stopping deportations of people that we have no idea who they are. Why can’t the Republicans bring up this fact? The dems are hypocrits by saying not funding will put the USA in danger. What about massive illegal immigration and open borders that they all support?

This reeks of Kabuki theater to me.

The timing is just too perfect. I hope I’m wrong and justice prevailed. With this Admin I trust nothing and no one but do hope for the best.

With Reagan we could “trust but verify” but with this POTUS... uh... no.

Why should they bother to appeal? They’ll simply ignore it.

Texas has the full force of law behind her and can take aggressive action against any who would try to move on it for the time being.
