Sticky situation: Outrage as Cadbury banned in US

Angry British chocolate lovers have vented their anger at a lawsuit brought by Hershey's (HSY), which effectively bars the import of chocolates made in the U.K. by Cadbury, a British brand well-loved by expats.

Using the hashtag #boycotthershey, fans of Cadbury products, such as the iconic Dairy Milk bars and Cadbury Creme Eggs, called for a boycott of the American chocolate giant on Twitter and Facebook. A protest petition on MoveOn.org had over 22,000 signatures by 1 p.m. GMT on Wednesday.

It comes after Hershey's, which holds a license to manufacture Cadbury chocolates in the U.S., agreed on a settlement with the New Jersey importer of Cadbury chocolates, Let's Buy British (LBB). As first reported in The New York Times, Hershey's accused the company of infringing its brand trademark rights and importing U.K. products that were not intended for sale in the U.S.

They are probably using their web site just for convenience.

After all, that want to be able to purchase a product with their own money, which they should be allowed to do.

It’s all about licensing. These things almost always settle. Probably, Hershey will import the stuff or someone will pay Hershey for a license to do so.

They can block it because they have the rights to the name in the US.

The problem isn’t the purchase, the problem is a poor corporate structure and ill thought sale. They sold the American Cadbury chocolate business to Hershey a long time ago. Then they started selling British Cadbury chocolates in America, but the sale says Hershey owns the Cadbury trademark in America.

Hershey doesn’t need to or want to import it. They own the American version of Cadbury. Since the 80s unless the Cadbury you were buying was in some import shop it was actually Hershey.

Hershey has changed the formula for the Cadbury egg to make it cheaper to manufacture.

I’m one of those really unhappy about it. Cadbury’s chocolate is far better Hershey’s!

I buy all my Easter candy from an Italian specialty shop in my city. All imported from Italy. Stuff from when I was a little kid.

Kind of like Canadian Nutella is not as good as the authentic German stuff. But round these parts, you can only get the Canadian.

I was just given a box of British chocolate by a family member that traveled there recently. It is Montezuma’s “planet friendly chocolate” organic and all that. Not bad chocolate though, actually pretty good. If I had known there would be all this fuss I guess I would have requested Cadbury cream eggs.

Hershey does have the option to sit on the license and not allow Cadbury’s into the U.S. It’s the least lucrative option, but an option.
