It’s not fine. It is stealth jihad.
Can we have a Noachide tribunal?
Good analogy.
We saw with homosexuals here and muslims in Europe how they start small and the fools say it’s not a problem and then their agenda goes on and on until it’s too late.
If SCOTUS forbade Oklahoma from banning Sharia Law, then Oklahoma must nullify that decision as utterly unconstitutional.
Art. IV Sec. 4 burdens the feds with guaranteeing that every state have a republican form of government and protecting each state against invasion and against domestic violence. The Supremacy Clause and the Ninth and Tenth Amendments put the Constitution and federal constitutional laws as the Law of the Land and those powers and rights not mentioned on the Constitution belong to the people and the states.
No American citizen should be subject to Sharia Law or any other unconstitutional and non-republican form of law or government. A SCOTUS decision prohibiting a state from banning Sharia Law is DIRECTLY OPPOSED to the wording and guarantees of the above-mentioned articles and Amendments of the Constitution. Oklahoma and any and every other state has the constitutional right to ban Sharia Law and to nullify any federal law to the contrary as unconstitutional.
However, it is definitely time for the states to reassert themselves through Article V. Re-federalize the government through Mark Levin's Liberty amendments before it is too late.
Nevertheless, state nullification of unconstitutional federal acts is simply the presumption of the Constitution in action, as confirmed by the Ninth and Tenth Amendments.
The Constitution simply does not support unconstitutional federal acts. The Supremacy Clause only supports those laws that are "in Pursuance" of the Constitution. The Tenth Amendment clearly confirms that the states and the people have those powers not delegated to the feds or prohibited to the states.
At this point in time, state nullification and state supremacy IMO is the only way we are going to recover our free constitutional republic, at least at the state level. I think the feds are beyond fixing. Barring a true miracle from the Lord, there is no way this mostly unconstitutional $4 trillion federal government will loose hold of its size and power. The hundreds of thousands of government workers, bureaucratic heads, and officials will never willingly pack their bags for home with no job. There is too much government self-interest at stake to believe they would willingly dismantle this beast.
I support the Article V effort. But the two efforts, Article V and state nullification, are not mutually exclusive and should be active in parallel.
Well, technically they are practicing law, in a system that is not recognized in this state...
Since it is not recognized, and the “system” is based more upon a religious faiths principles, then it is technically non0binding other than to the parties involved...
If this process wants to be recognized and made official, there are a lot of things that have to happen legally, at both the state and Federal level...
It is not something that is going to effect most people in a forum like this...
If for some reason you are somehow called by this “system”, either as a party to, or a witness to some violation of this “systems” parameters, then you, a citizen, not of that faith (religion) can certainly refuse to appear, and no legal binding summons can make you appear before that tribunal...
As it stands now in this country...
The best way to not allow it to get any further, is to refuse it, not recognize it, and hope the dunderheads we elect into office feel the same...
IIRC, there are people (US citizens) in our Asian communities that adhere to a counsel of elders in some densely Asian populations areas that go to have “issues” resolved...
None of that legally binding in our conventional legal system of laws, unless both parties agree to that ruling of those elders...
Knowing that this cultural/religious system is in practice by many different ethnicities does not cause me too much concern at this time...
If as result (punishment) of a ruling of a system like this violates our existing laws... Then that’s when our system kicks in...(i.e.: homicides, body mutilations, servitude, etc etc etc)
You mean “re-colonize”???
Invaded in the case of islamists...
I know I’m just being picky, I just like the direction you took here... Honest...
Bump your comment.
I vehemently agree with your assessment. The only way the constitution will ever be restored is through the exercise of the individual and state powers therein.
What is their position on baking wedding cakes for same-sex marriage?
No argument from me but rights only belong to those that defend them.
Well, I believe our rights and freedoms belong to us because they are God-given and “unalienable” which is explicit in the Declaration of Independence and implicit in the Constitution, regardless of what we do. We don’t “earn” our rights and freedoms, we are born with them.
But man can and will violate our rights and freedoms if we let him, which is what I think you’re talking about. Man is a thief and it is up to us to “hold fast” that which is ours. If we don’t and they are stolen from us, they are still our rights but the thief now has what rightfully belongs to us.
I agree with you and Thomas Jefferson that “the price of freedom is eternal vigilence.”
John Adams quote on a Tea Party Express Site that just popped up on my Facebook page - thought it fit right in with what we were talking about...
