Grand Jury Declines to Indict NYPD Officer in Eric Garner Chokehold Death: Sources

A New York City grand jury has declined to indict an NYPD officer in the chokehold case of Eric Garner, the unarmed man who died while being arrested on Staten Island earlier this year.

In opting not to indict, the panel determined there was not probable cause that a crime was committed by NYPD officer Daniel Pantaleo, who was seen on a widely watched amateur video showing him wrapping his arm around Garner's neck as Garner yelled, "I can't breathe!" during the summer altercation.

WHY can’t these race-baitors like the Mayor and Barry, give a speech not about them, not agitating, and SAY THAT THEY EXPECT CALM AND LOOTERS/ARSONISTS/CRIMINALS will be ARRESTED? (rhetorical, I know, it’s because they WANT THE MAYHEM)

Cardiac arrest , obesity, and severe asthma of course played no role in his death..

He should have been in better health.

Let this be a message to all who fail to obey and are not in the best shape.

All those suffering from health issues have been warned.

The New York City Police Department has banned the use of choke holds, the restraining maneuvers that cut off the flow of blood and oxygen to the brain and have been blamed in the deaths of suspects in New York and other cities.

The directive comes as police departments around the country have prohibited or reviewed the use of various choke holds by officers. It also underscores a nationwide debate on the appropriate use of police force, from 9-millimeter handguns to “hogtying” to pepper spray.

The number of deaths in police custody in New York, including some involving choke holds, has been rising in recent years. Police officers and other experts said alternatives to the choke hold could include various nonlethal restraining devices like Velcro straps, handcuffs or water cannons.

A cop and military trainer was on the radio today. He never goes for the choke hold and if there is one, you are supposed to set the person up asap and slap on their back to restore their breathing or call 911. The choke hold was too long and when someone says they cannot breathe even if they are thugs, that’s a big red flag.

This man and his loose smokes-for-spare change scheme was a threat to their very existence. He had to be stopped for the common good.

The guy is dead and his death was ruled a homicide by an illegal choke hold by the coroner and forensic experts.

...

Show me the New York statute that makes it illegal.

And while the coroner did rule the death a homicide, he listed a whole laundry list of causes without specifically mentioning a choke hold. I don’t know what other “forensic experts” you are talking about.

Yes, I saw that, but Garner could still breathe and talk after he was down. The coroner didn’t seem to find any damage that would indicate a choke in the medical sense.

Seems to me that the choke hold was a contributing factor in his death, just as were weight and underlying health conditions.

The cop could have shot the criminal and would have garnered (no pun) sympathy. Using non-lethal force (which he did, regardless of the outcome) causes more headaches.

Holy cow, you got just about everything wrong in that piece! From the cause of death (the coroner ruled it was homicide due to compression of the neck) to the actions of the grand jury.

Additionally, you keep bringing up his record, which was irrelevant to the arrest.

Not any more than him committing crime and resisting arrest. His stupidity was the greatest contributing factor. Case closed, as the Grand Jury saw it.
