Charges Dropped For Cop Who Fatally Shot Sleeping 7-Year-Old Girl

The shooting happened just after midnight, back on May 16, 2010.

A SWAT team had conducted a raid to search for a murder suspect. Weekly ended up being first through the door.

There was even a film crew on hand to film for a reality show about murder investigations. Weekley says that another SWAT member had thrown a flash-bang grenade, which temporarily blinded him. That’s when he fired the shot that killed Aiyana who was asleep on the couch in the front room of the house.

Doubling down on this claim, in court he actually testified that Aiyana’s grandmother had somehow “touched” his gun, which made him fire the shot. But he failed to explain how he could tell she had done this when he claimed he couldn’t see anything at the time.

The prosecution noted that even having his finger on the trigger of his submachine gun was improper. “He could have avoided injury if he had followed his training,” Assistant Wayne County Prosecutor Robert Moran explained.

“He didn’t, and as a result of him not following his training and not following the mandates of ordinary care, someone was killed.”

But ultimately, the arguments and reason didn’t win out.

IIRC the suspect the cops were after lived in a different unit, upstairs from the girl they murdered. To add to Jocon307’s comments law abiding poor people cannot help that their neighbors are often criminals. Should they be less safe from murder by cop than people who can afford to live in the burbs?

Non-police would be convicted and imprisoned for that.

“So true, but I seriously doubt that you would ever have a SWAT team sent to your house. “

SWAT raids are now topping an estimated 80k a year, with the bar criteria for one going low enough that an ant has to duck. Numerous wrong house raids, and raids on minimal information. One family got raided because of tea leaves in the trash.
Why in the world would you think people don’t need to be concerned?
And it isn’t simply that ‘rare’(not really all that rare) mistaken raid. It is their entire attitude behind it. All is well, so long as a cop isn’t harmed. Everyone else is nothing at all.

“These are sensationalism as its worse, getting JUST your kind of reaction. I wouldn’t ever have a SWAT team needed for me or my actions either.”

Sensationalism? What is sensationalism is the arguments cops make to justify this kind of paramilitary activity. Everyone and their brother becomes a ‘deadly threat’, if cops want to use SWAT. Why don’t you address cop sensationalism too?
And this is not sensationalism, this is a real event, once again showcasing how unprofessional LE has become. Anyone else acting this incompetently in their profession would be charged for it. He, by being SWAT, is claiming to be an expert at handling his weapons, and then fails to do so properly.
This deserves an angry response.

“However, these stupid stories are what many people thrive on. They actually think they are real. I doubt MOST of them.”
Based on what? Because that is what you want to be true?

This cop acted incompetently, and without regard for harming others. He then clearly lied, trying to protect himself.

“After the dismissal, the only charge Weekley faced, was a relatively minor misdemeanor charge of “careless discharge of a firearm causing death.””

A relatively minor misdemeanor?

How does that work?

Oh man, the system is so screwed up. There’s just no accountability anymore.

“Compounding the tragedy is the fact that the police threw the grenade into the wrong apartment. The suspect fingered for Blake’s murder, Chauncey Owens, lived in the upstairs flat, with Charles Jones’ sister.”

“Owens, a habitual criminal, was arrested upstairs minutes after Aiyana’s shooting and charged for the slaying of Je’Rean.”

The instant a trigger is pulled, there is an intent to do harm.

Why not save your anger for someone who is guilty of real crimes instead of a poster trying to express her opinions on this site? Isn't this the FR where we are allowed to express ourselves without having to deal with folks like you who get ANGRY over an opinion?
You need a life if my simple FR post angers you to this point; you really do. This is a WAY over the top reaction.

this is another example of real justice being subverted.

it’s why conservatives like me will not have cops’ backs when shtf. they would just as soon kill me in my own house and cut some deal with the da or judge to drop charges. nobody loses job, nobody gets any justice and can’t move on with their lives because justice was fairly administered.

So attracting the attention of a swat team is grounds for exactly what, then?

From Wikipedia: A SWAT team is a group of highly trained police officers who deal with very dangerous criminals. SWAT is an acronym that means Special Weapons And Tactics.

I would say that if you were to attract a SWAT team that would be grounds for considering you a VERY, very dangerous criminal.

You can’t count on being safe from this malfeasance just because you are law abiding. Many times they go to the wrong house.
I once had a cop burst through the door to my back stairs because the landlord downstairs had a burgler alarm that went off. We scared the cr*p out of each other.
Luckily it was the middle of the day. Luckily I wasn’t sitting there rolling or joint or cleaning my gun or something else that might have “provoked” an undue reaction.
But I often look back at that and shudder that it might have turned out badly.

You should shudder. You WERE breaking the law. Or do you consider laws that YOU don't like as being OKAY to break?

If your landlord DIDN'T have a burglar alarm he would have been in trouble with the rest of the tenants for not having a burglar alarm to protect them. The burglar alarm was bad for you that day. So what? Are you the only one whose ever been shocked like that?

Of course, if you REALLY needed a cop and he didn't HAPPEN to be around when YOU wanted him, then he would have ALSO been wrong. Damned if they do and damned if they don't--no matter what.

No, I never said that they should. But you know that. You should have heard O'Reilly tonight. It was about the folks in Ferguson and their "rights" to loot, burn, create havoc disguised as "free speech." They hate the cops and think it's OKAY to express themselves by violence.

Have YOU ever lived in a third world country? Have you ANY idea what cops are like in places NOT the USA? Folks bellyache as if our cops are so bad but they haven't a CLUE what it's like in other parts of the NON-western world. We are SO lucky to have the thin blue line who are city/country employees.
MOST countries have NO "thin blue line who are city/country employees." They have only federal police who do all the policing...and they answer to NO one.

Go live in ANY third world country for a year, no, a month, no a week, no ONE day and you will see what "bad cops" are. Our cops are the best in the world and if you don't believe me, see yourself. You won't, of course. You will stay in this country, in your own state and town and on THIS site and wax poetic about our USA cops.

God bless you...and you can't even say that in some parts of the world. Count your blessings about our cops and our freedoms ... if you can.
