An analyst says Darren Wilson used reasonable fear legal loophole to get even with an African American teenager.
An American political commentator who is also a trained paralegal says white police officer Darren Wilson, who was not indicted for killing an African American teenager in Ferguson, had issues with people of color, but he hid them under the legal loophole of reasonable fear.
Speaking with Press TV in a phone interview on Tuesday, Susanne Posel, chief editor at OccupyCorporatism and the US Independent.com, said, The legal definition of reasonable fear is whats keeping us from indicting him.
Posels comments come after St. Louis County prosecutor Robert McCulloch said that Darren Wilson would not be indicted and that he would not even face charges for killing the 18-year-old Michael Brown in Ferguson on August 9.
Its obvious that Darren Wilson overreacted, and someone who is overreacting should not be in charge of a semi-automatic weapon where they can do harm to other people, even in an official capacity like a police officer, Posel said.
But the unfortunate part about the grand jurys decision is the legal definition of reasonable fear and that is something that I dont think, and Im assuming this that most of the protesters understand, she continued.
Its a legal loophole where police officers are given basically carte blanche if they say that they have a reasonable fear that their life is in danger, the grand jury has to prove that they were not in a reasonable fear that their life was in danger, Posel noted.
She explained that giving police officers a green light to shoot at people whenever they feel their life is in danger is a legal loophole under which officers might even hide their own personal issues with citizens.
She said that it would be very difficult to disprove in a court of law what a cop says he has felt. First of all you cant prove a negative, and second of all you cant disprove someones feelings since the law allows the police officers to use excessive or deadly force when they feel that their life is in danger.
This is a problem, she added. Police officers should not be given carte blanche to just shoot at people because they think they might be in danger.
Posel also pointed out Darren Wilsons reputation of a rookie cop, who was fired for targeting African Americans along with three other officers. She said it showed that the mindset of Wilson might not be that he fears his life is in danger but that he has issues with people of color and he is using fear to hide under this clause.
Why would anyone have “issues” with “people of color” these days?
now they think are psycologists
“legal loophole”?
Over-react? I would have shot him when he slammed my door on me and tried to reach in my truck. How’s that for over-reacting?
“Iranian Press TV”
Sure it isn’t Obama/Holder Press TV?
What issues?
You mean the ones your making up to shield Michael’s parents from their personal responsibility raising a thug and taking responsibility or at least apologizing for their son’s criminal behavior?
The Iranian “Press” is in on this now? LOL!
Then again, maybe she's just projecting her own racism.
Perhaps Susanne should have withheld her commentary until enduring a life/death situation. She’s certainly not speaking from experience or an informed point of view.
What’s the difference?
Hmmmmm ..??
If you saw a 300# 6’4” person charging toward you .. are you really thinking about whether he’s black or blue or pink or green ..????????????????????????
I don’t think so .. what you’re thinking is: HOW DO I STOP HIM!!!!!!!!!!!
So she is saying that her assertion, without any evidence, that he is a racist take precedence over that fact that he can prove he had a good logical reason to fear for his life.
Listen to the audio. It’s screamingly funny.
I’m 6’ and 350lbs. I’d laugh.
I suspect that if he has issues with people of color, it’s the people of color he encounters daily on the job in that particular hood. Evidence of the aftermath seems to suggest that da hood is not populated by little angels.
Which of the two participants was engaged in a violent incident moments before the shooting?
When observations like this are made, why doesn’t some clear minded person just ask, “so, how long have you been able to read minds?”
The person will look like a fool and if there’s an audience, they will laugh at him.
Maybe some connection to iran’s favorite daughter? gal pal val.
