Don’t Count Out the Court [which may strike down executive amnesty]
Daily Caller ^ | 11/20/14 | Mickey Kaus

With Obama’s executive amnesty imminent, anonymous White House aides are cockily dismissing John Boehner’s threatened lawsuit against it as a stunt. Even among opponents of executive amnesty — and I’m with them — there’s a tendency to pooh pooh the suit. It’s a loser, it will take forever to decide, it’s an attempt to ‘redirect Republican rage’ away from budgetary remedies like denying funding, etc.

Not so fast. I’m all for giving defunding a try — also holding up appointments — but don’t sell the lawsuit short. I’ll even go so far as to lay down an Yglesias style marker: If Obama’s executive action is as broad as described, the Supreme Court will strike it down.

Boehner is shirking his duty, shoving it off on the Judiciary so he has cover. He is a coward.
FUB. Hard.

Just like they were sure to strike down ObamaCare?

That assumes that the lawsuit is the only action Congress or the House will take - and I’m not sure.

Plus, remember, there’s another line of political resistance: the States, i.e., Republican (and maybe even a few Democrat) Governors and Attorneys General. One move may be for the States to simply not respect Obama’s fake work-permits for illegals. Then Obama’s Justice Department would have to sue to compel compliance, and I don’t think most courts would side with the feds on this one.

Seriously?? I get so sick of this make-believe-ism anymore. Hannity and others do this all the time. When are people going to figure out the libs took over the courts a long time ago. The Supreme Court put its stamp of approval on Obamacare. No one is going to defeat utter lawlessness in the damn courts. The courts are bought and paid for by the libs. There is no path for justice there anymore, particularly with respect to any madness coming from the white hut. Klayman can keep dreaming but the only people who win will be the so-called Dreamers. The gig is up. Country’s gone, thanks to the devil with a pen and a phone and a bunch of republican cowards. It will take a lot more than a lawsuit to fix this disaster.

This isn’t really about any amnesty. This is really just a big middle finger in the face to everyone who voted against Obama’s democrats in the mid term election. Obama’s a petulant, immature brat and he can’t help but show it.

Even if the Supreme Court rules it unconstitutional - then what? Obama already showed his disdain for the court and its opinions.

Who is going to make him obey the court ruling? Is someone going to arrest him? Republicans aren't going to impeach him after the shellacking they got over impeaching Clinton.

He wouldn't be the first Executive to defy the Court either - The court can declare whatever they want - they have no method of enforcing it.

Obama and the Democrats have been ignoring the law, flaunting the law, and breaking the law since they were elected. Coupled with the media - Pravda USA they do what the want. Government - thy name is anarchy.

Obama could not succeed without Boehner.

Boehner stymies Republicans, he does not oppose Obama, and when Boehner does take an action it is to defend or to one-up Obama in advancing Obama’s agenda.

On July 2, 2013 when Obama announced the implementation date of PPACA mandates would be modified from January 1, 2014 to 2015, Boehner did not challenge Obama’s authority to modify an act of Congress, instead he was indignant that the change applied only to companies with more than fifty employees and not to smaller companies and to individuals (e.g., http://www.speaker.gov/video/boehner-unfair-delay-obamacare-mandate-businesses-while-leaving-families-hook). Boehner then sought a series of bills to delay PPACA mandates for smaller companies and individuals (e.g., http://talkingpointsmemo.com/dc/boehner-considering-bill-to-delay-obamacare-s-individual-mandate-for-a-year).

Boehner wants to sue Obama for modifying acts of Congress (PPACA).

He now he wants to go to court to halt Obama's "Executive amnesty"... a direct usurpation of Congressional authority.

To rein in a lawless Executive the proper action for Congress to take is impeachment, not to shove their duty off onto the Judiciary.

Boehner’s is incompent.

There is now a full scale assault upon the United States by a lawless and corrupt Executive led by Obama. While he might be sufferable in ordinary times Boehner is not the man for these times. He has no idea what is going on around him. He MUST go. He is the key impediment to the Republicans' ability to confront Obama.

If this amnesty is struck down or stopped look for riots and civil unrest. Along with Ferguson soetoro will have his race war.

Looks like something out of Travis McGee novel.

I got nothing against blacks or Latinos but it would be pretty stupid of them to think they could survive a “race war”. Pretty hard for them to “get out of uniform”.

Yes, an Article V state convention to propose structural amendments that restore federalism is our only hope.

John Boehner is to Obama as Obama is to Vlad Putin.

This does not speak well of Boehner!

Obama is counting on his actions to be so entrenched by the time that SCOTUS gets around to ruling that the decision will be irrelevant. In the meantime, Boehner and McConnell will continue to make excuses and bow to their leader.
