BATON ROUGE- Law experts are questioning a search warrant police obtained following a citizen's complaint to the mayor about an officer's post on Facebook.
The man, who spoke on condition of anonymity over his uneasiness toward the police department, said he emailed a picture he saw on Facebook showing what appeared to be an officer sleeping and a second officer posing next to him. The man said he believed the officers were out of line.
"I emailed it to Mayor Kip Holden's office and I emailed it there thinking, I kind of believed the police would have just deleted the photo, so I went over their heads," the man told WBRZ in an exclusive interview with the Investigative Unit.
Following the email exchange, the mayor's office sent the photo and the email chain to the Baton Rouge Police Department. The department began an investigation into the unidentified man.
"They told me they were going to press charges for me emailing the photo of the cop sleeping to the mayor's office," he said. The man told WBRZ, he was contacted via email and told he could be charged with defamation. Police were able to identify him by securing a search warrant, gaining access to his computer IP address, phone records, and place of residence.

No need to really respond unless the citizen wanted some kind of response.
Which could just have been, “the guy made a goofy mistake and he’s been informally reprimanded.”
Mayor’s office would probably have been quite satisfied with a calm, mature response like that.
What a novel idea, calmness and maturity to counteract goofiness.

how about the cop that was sleeping on the job get reprimanded? and the cop who posed with him (and likely posted it online)?

Defamation is a civil matter, if I’m not mistaken. You can’t “charge” someone with that, you have to sue them in civil court and make the claim.
Which, of course, would open the department up to a nice, big, juicy countersuit that any up and coming lawyer would love to sink their teeth into.
I would blow it up to poster size and spread it around. The bully will make his appearance.

IMHO, when citizen sends email to mayor, mayor forwards police, they should just tell their guys to get their act together.
Certainly police should not open an investigation of the citizen. Bigtime overreach reaction, IMHO.

Yes! Excellent question as the search warrant had to get judicial approval. So, not only do you have a worthless mayor and COPs but also a judge who is corrupt. Sounds like a great place to live....

Just dial up your elected, pro-2nd amendment, constitutional sheriff to come down on the thug cops like a ton of bricks. Oh, you don’t have one of those. Too bad, Sparky. Maybe you should get off your fat butt and elect one.
