FLASHBACK: Obama Administration Dumps Quarantine Rules

Politico initially reported in August of 2009 that the Obama administration examined Bush administration 2005 quarantine regulations, which were criticized by civil liberty advocates.

In April 2010, Politico reported the administration “quietly dumped quarantine rules that would have required air passengers to submit more information to airlines and strengthened the government's authority to detain travelers suspected of carrying disease.”

So Barry dumped the Quarantine rules, but still let the TSA stick their gloved hands (and proven they sometimes use the same gloves on more than one person) up god knows what nooks and crannies on toddlers and grannies alike st the airport, but hey let’s just wave the people comming from outbreak countries right on by......?????

AND some members of my family STILL think I am crazy for thinking Barry wants to destroy this country????

There is so much irony here...

In the past, I have had arguments with FReepers who claimed that government has no right to quarantine anyone, while I insisted that the government has a duty to protect citizens from disease and that individual liberty does not trump people’s right to not be needlessly exposed to infectious disease.

And now, I see people complain that not enough is being done to quarantine people who *might* have an infectious disease.

I swear, as a group, FReepers are all over the place.

Here is a link to a blog about executive orders regarding quarantine, which is obviously written by someone who thinks that putting people in quarantine is akin to throwing them in concentration camps: http://www.policestateusa.com/2014/executive-order-quarantine-list/

The disease lists are about halfway down the page. It seems that several presidents have updated the list of diseases subject to quarantine over the years. Ronald Reagan was the first to add viral hemorrhagic diseases (Ebola and several others).

I suspect that once this Ebola outbreak is over, people will forget about it and go back to insisting that even the threat of quarantine is an unsupportable infringement of civil rights...

Note that the word "quarantine" shows up in a very interesting place with respect to arguments that Obamacare Democratcare is constitutionally indefensible.

More specifically, as evidenced by the excerpts below, when Justice Barbour, I believe, borrowed language from Gibbons v. Ogden to emphasize that the states have never delegated to the feds, expressly via the Constitution, the specific power to regulate intrastate healthcare, he expanded the idea of prohibited federal healthcare laws by referencing quarantine laws of all things.

And speaking of prohibited federal laws, the Supreme Court had also clarified in general that powers not delegated to the feds expressly via the Constitution, quarantine laws in this example, are prohibited to the feds.

”From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added].” —United States v. Butler, 1936.

So federal quarantine laws which address intrastate issues are based on wrongly usurped 10th Amendment-protected state powers like many other federal laws.

My reading of the article is that the Obama Admin didn’t actually dump them. That they pulled the revisions back when they were still at OMB and kept the old rules. The article strongly infers that there was widespread pushback against dumping the rules, and the Obama Admin caved.

Anyone else read it that way?

Dear Liz,

Quarantine rules are always a good thing, because they protect the rest of us Americans, who have been living in a ‘bug-free’ nation, s opposed to all the sleazy motherlovers that haved invaded our nation.

I believe that the American populace, since ‘dah gov’mint ain’ta gonna do it’, should declare open season, ‘for the common good and survivability of the nation’.

a) Weakens America/Americans
b) Distances America's allies
c) Strengthens America's enemies
d) Serves Islam

Or some combination of the above.

The purpose of the “Bring Out Your Dead” ping list (formerly the “Ebola” ping list) is very early warning of emerging pandemics, as such it has a high false positive rate.

So far the false positive rate is 100%.

At some point we may well have a high mortality pandemic, and likely as not the “Bring Out Your Dead” threads will miss the beginning entirely.
