Reese Update: Motion To Vacate Felony Charges

"The court appointed attorneys in the Reese case have filed a joint motion to vacate (throw out) the felony convictions and sentence them under a misdemeanor statute."

"Rick, Terri and Ryin Reese were convicted in 2011 of four counts of Form 4473 (Brady check) violations. According to agents who testified during trial, the Reeses ran all of the required background checks (the Brady checks) through the FBI processing center for all sales, including the undercover agents who purchased the firearms, and that none of the paperwork was missing."

For those of you who do not know about this case, the Reese family had their business and lives destroyed when the 'just us' department targeted them and their gun shop with undercover agents, ultimately leading to a raid on their home and store, using helicopters and armored vehicles. Everything they owned was 'confiscated' and the whole family except for one of the sons were imprisoned. So even if the felony charges are dropped, their lives have been ruined and I certainly wouldn't wait for a "gee, were sorry. It was all a big misunderstanding", from the government.

Has this ever been on Fox News?

This is the first time I am hearing about this.

Stossel should do an hour long special on it

This is only one of the reasons I have lost/am losing, faith in this US government. Just for those few who wonder about me.

Sadly, their lives have been destroyed and they won’t get any recompense even if their charges are vacated. At least I don’t think they’ll get anything. As for their stuff that was confiscated? Where is it now? Will it be returned in the same condition it was in before the raid? Pretty disgusting situation. Just goes to show what “they” can do to you if someone gets po’d at you for whatever reason.

So these peoples lives were ruined based on the testimony of a drug cartel member, who was running guns with the help of Holders Just Us department, who said he thinks they knew he was doing illegal activity???

What the G**d***f**INGf**???????????????????????

Yea, I remember this case.

Once you are in “the system” it is very difficult to get out. It is a money making scheme and there is no incentive for justice to be done. After all, if they let them out then the prison loses. The county can’t seize all of the Reese’s life savings and real estate(they’ll still try but it will be more difficult). Probation office loses more “customers”. Plus, the family can’t be disarmed. So, what’s the upside for the courts to do the right thing?

They were sentenced to prison time far longer than stated in plain language in the statute. And the prosecutors are actually asking for more time? A decent judge(an oxymoron) would throw the whole thing out and the prosecutors should be held liable for the time the Reese’s have served.

I’m not sure if it has ever been on ANY national news. Stossel certainly could do a great special on it. FWIW, I’ve had numerous interactions with the family at gun shows and had been to their store a couple of times. Always seemed like good folks to me. It has been very sad to watch their lives destroyed.
