I would agree. I would also want to know what authority the President has to modify any law via executive authority. I suspect that the current administration will take far greater liberties than what I would believe appropriate.

I would say he has none. But I live in a different world than Obama.

Military offices fall under the advice and consent power of the Senate, so they are of Constitutional origin. Usually, it's they generals who have their stars approved by Congress. The advise and consent clause also allows delegation of consent for lesser offices directly to the President.

I agree but that is what is setting up this issue. If Obama (and by inference the DOD) does not have the authority to modify the oath as it is prescribed by law, then they cant waive a portion of it either.
Ultimately I believe the fix needs to be a change to the law.
