Rick Perry files habeas corpus motion to dismiss case

Well, what fun is that? Many were hoping to munch popcorn and see Rick Perry’s attorneys spend the next few months ripping Travis County DA Rosemary Lehmberg to shreds over her blatantly political effort to get the Texas governor indicted for cutting off her funding. Accusing Perry of being drunk with power is rather amusing, under the circumstances, but apparently Perry has better things to do with his time:

The writ claims the charges of abuse of power and coercion filed against Perry are unconstitutional and that Perry was simply exercising his constitutional veto powers when he vetoed funding for the Public Integrity Unit last summer.

“By seeking to criminalize not merely the veto itself, but the Governor’s explanation for it as well, this prosecution also violates the Governor’s rights under Free Speech Clauses of the United States and Texas Constitution…” the writ says in part.

The writ also says the indictment violates the constitutional separation of powers and the speech or debate clause in the Texas Constitution.

Note that this is not a motion seeking to quash the indictment, but for the court to rule in essence that there is no there there by dismissing the entire case with prejudice. As the page count indicates — sixty in all — Perry’s attorneys are bringing the kitchen-sink approach to the motion. It specifies in detail all of the ways in which the two counts violate the Texas constitution, the First Amendment, and the separation of powers.

I’d PREFER the optics of a 1000 Perry Supporters parading in Austin wearing shirts with the picture of the drunken lesbian DA on it during a trial. THAT would be fun.

it is a sad thing when ones ego is so big that only they can think they can save the world.

It is even sadder when they think they can run for national office and not have to tote their past baggage.

Perry will have to tote his baggage, past and present. But that doesn’t
mean legality can’t be applied to them.

Head of the Public Integrity Unit

Third drunken driving arrest with a blood alcohol level nearly three times the legal limit.

Austin is the “San Fransisco” of Texas...

Unfortunately Dallas, Houston, San Antonio, El Paso and entire Rio Grande Valley are havens for leftists, abortionists, homosexualists and atheists. The good parts of Texas are in the far-flung exurbs and the rural areas. That's where the upstanding pro-God, pro-life and pro-gun people reside and thrive. Even Ft. Worth, once Conservative and thoroughly Christian, has gone downhill just within the past 15 years as metrosexuals have moved in.

The Left just wanted the mug shot and the word “indicted” linked to Perry. They’ll take that as a win when the case gets tossed.

And unfortunately, just like the major cities, they are being populated by illegals. We are getting squeezed.

That’s what the highly esteemed and full of integrity woman kept asking the officers who were booking her and trying to get her to settle down.
I think Greg is a prosecutor in the Country or something like that.

I did not know that.

Couldn't have been Greg Abbott.

Maybe it was the same staffer who picked her up the last time she was nearly triple intoxicated.

I was thinking of crafting a “Keep Austin Criminal” with one side showing a police mug shot of Lehmberg, and the other a police mug shot of Leslie Cochran. Austin loves its scumbag criminals
